Blacklocks mistake in going before the Federal Court was not being the Toronto Star.
The judge ruled Blacklock’s terms were “plainly visible” and clearly prohibited password sharing without permission. Blacklock’s even sent the password buyer two written notices with a number to call if they intended to “share or distribute content.” The judge dismissed it as irrelevant.
What passwords does it apply to?
Any kind at all. The rule applies to any ordinary password to websites, newspapers, video and music services, library databases, scientific or technical journals, peer-reviewed periodicals, you name it.
That part will get fixed in no time.

I think the gist of the ruling is companies need to make it so users cannot share login credentials and not rely exclusively on shareable usernames/passwords to protect content. Users are not smart enough to understand that they shouldn’t share passwords even if you tell them.
If additional technical measures were taken, like authorizing specific devices to run specific software, or mandatory two factor authentication on each login, requiring physical presence of subscriber, this ruling would not apply.
In my opinion no Canadian taxpayer should be obligated to pay for any content produced by a government funded media corporation. The taxpayer is already paying for the Toronto Star…why should we need to buy passwords?

This is pretty much already happening organically, but it requires a fair bit of expertise to set up if you don’t want to be beholden to Big Tech; and it costs money to run the infrastructure. So small orgs like Blacklocks are screwed out of the market.
Everyday, the most basic of norms is turned upside down by well educated, well connected idiots. But Canada’s institutions seem to be leading the race to obscurity and failure.
If passwords are elminated, then sites are ad dependent. Ad dependent means under the control of Google which is what they want. Big corps don’t care because they conspire with Google.

Won’t password protected sites just verify each password using customer? Examples: ask for cell number; message customer email requiring email response; text a unique verification code to customer that must be used for access. Some password protected sites do this now or require a new password every 6 months.
Maybe extra steps are cost prohibitive for small business?
Can Parks Canada entry passes be shared?

I’m not clear on how this doesn’t extend to every form of proprietary media. I am a writer who enables digital rights management on content I publish online. What’s to stop someone from copying my work and distributing it for free?

Looks like the Federal Court is taking its cue from Sockboy and his socialists: you have no property rights, either physical or intellectual, in a country where every “fundamental right” can be ignored by a government on any “reasonable” grounds.
