Affirmative Action Seems to be in Trouble: The oral arguments before the Supreme Court suggest that at least six justices are not strong on the status quo. What if the Court goes crazy and says public and perhaps even private colleges may not discriminate based on race?

“The way to stop discrimination on the basis of race,” Chief Justice John Roberts wrote in 2007, “is to stop discriminating on the basis of race.”
The privilege people of colour received has never been appreciated, it has lowered standards and weakened our institutions. The absolute best people need to be placed in positions regardless of skin colour or gender. Merit and qualifications should be all that is required.

If the Court rules that AA is unconstitutional, then it’ll be a big win for our basic Freedom of Association.
The segregated Ivies, State Uni’s and will look retrograde in a few years. The market will be allowed to decide again.
it wouldn’t surprise me if Roberts went for a watered down response, and both Thomas and Alito go to town to AA and Disparate Impact
The question then becomes if Thomas has 5 votes for his opinion.
