In a major blow to the federal government, a judge in Detroit has declared America’s female genital mutilation law unconstitutional, thereby dismissing the key charges against two Michigan doctors and six others accused of subjecting at least nine minor girls to the cutting procedure in the nation’s first FGM case.
The historic case involves minor girls from Michigan, Illinois and Minnesota, including some who cried, screamed and bled during the procedure and one who was given Valium ground in liquid Tylenol to keep her calm, court records show.
The judge’s ruling also dismissed charges against three mothers, including two Minnesota women whom prosecutors said tricked their 7 -year-old daughters into thinking they were coming to metro Detroit for a girls’ weekend, but instead had their genitals cut at a Livonia clinic as part of a religious procedure.

I think you’re right that so called political correctness is at play, but IMO I believe the real motivator behind the deafening silence from feminists and SJW’s is, fear. The upside is if this ruling stands than there are a slew of incredibly bad laws that will be removed from the books for similar Commerce clause violations. This practice can supposedly be stopped using criminal assault laws already on the books. That would be a good way to approach it, because then they could take away the medical license of any so-called doctor who performed it.
Yes, if this stands incursions into criminal law by the federal government are over. I highly doubt that is going to happen. The decision will be overturned on appeal. By normal reasoning federal Obamacare is illegal but the courts allowed it to stand. Mind you, once Justice Bader Meinhoff is gone, it might be time for states to start a new appeal.

The procedure is not a religious requirement, is demonstrably harmful to children, and demonstrably harmful to them as children, and while, and when they grow into womanhood, for the duration of their lives.
I understand that the judge may not see a Constitutional argument to be made to support this law in the Commerce Clause.
It’s possible to amend tort law to allow for suing the Dr. and nurse/s, and their parents, or hospital, or clinic, for damages that cause life long harm.
No statute of limitations for causing life long harm.
Give it to a jury, ask the jury for millions.

If this stands some unconstitutional federal incursions on states affairs (there are a lot of them),will have to stop. It will be interesting to see who supports the appeal.
