Robert Day (defendant) portrayed his Twitter feed as fact, not commentary.
The Plaintiff (Levant) must prove 1) his claim has merit, 2) the Defendant has no defence to the charges and 3) harm has or is likely to be caused by the Defendant’s actions.

[39] This was not expression on a matter of public interest, but personal attacks (3)
[41] His statements were motivated by malice (3)
[49] I find that there are grounds to believe that the defendant has advanced no valid defences. (2)

It is looking grim for the Defence.
“Canadian Cynic” acquired some blogger fame ten years ago or so, when he blogged “f**k your tears” at the mother of a Canadian soldier killed in Afghanistan when she got some media coverage of her grief. I can’t be arsed to search up the details, he’s a nobody if ever there was one (although respected and admired on the internet by yer average Canadian lefty), but it would brighten my day if he got sued into greater poverty.
Robert Day is an a&&, he got his a&& handed to him, and he is going to get his a&& kicked again when the final judgement comes down against him years from now.
If ever there was a need for a public stockade with ample suppliers of rotten food & shi! this guy would be it (best to leave him in it until the final verdict).
Day has a long history of misogyny against any woman that’s off the far left reservation. Absolute vile scum of the earth.
Well, I will believe that the courts in Ontario are NOT just another ninth circuit when it see evidence that they have ever ruled against a socialist.
Isn’t the Ontario court the one who is slow rolling the gas plant case against Wynne, and is just waiting long enough for everyone to forget before they NEVER SEND A LIBERAL TO JAIL FOR ANYTHING EVER?

While I don’t believe the Rebel was using the Fort Mac fundraising as a revenue generator, I’d be more than happy if they profit from from defamation suits against the ilk of Day. They should do another one.

Better be careful how I word this: After reading the tweets in question, Mr. Day seems like a real dickhead. Looks like Ezra is going to win this one. Kind of an important case although it should already be established in law that you can’t tweet lies about someone with impunity.

This seems so far to be even handed and following Canada’s ever increasing opportunities for Attorneys to maintain costly Life-Styles. However the Ontario Courts will and can arrive at a determination The Plaintiff is not being co-operative enough to compromise and bring forward a “slap on the wrist”; —Wynne’s corrupt Staff buying-off of a Candidate–; and sharing of the costs by Mr. Levant when the Defendant is so much at Fault.

Yep, the key word is “malice.” That is VERY serious.
It doesn’t mean “Cynic hates Ezra” because, well, #obv.
Rather, legally, it means you “maliciously” KNEW what you wrote was false, and published it anyhow, for the express purpose of harming another’s reputation, income and so on.
Obviously, this “knew” bit can be rather hard to prove in court — we aren’t mind readers.
However, if it CAN be proved, through dated documents and sworn testimony about conversations, etc., you are in super dooper deep deep doo-doo in the eyes of the law.

OMG I didn’t know that — I try to ignore him and frankly had forgotten he existed until this lawsuit.
That’s just one of the “facts” that Cynic has “reported” over the years. I recall all the SDA posts from years back, fact-checking his laughable assertions, along with highlighting his statements about women etc.
