The government is going to tell you whether or not your spouse deserves an equal share in the income from a business you jointly own. They will tell you whether or not the contribution between spouses is equal and reasonable. They are going to monitor anything you jointly own with your family and assess the relative market value of each individual’s contribution in order to determine who should get what.
Own a business with your dad? They are going to tell you what a reasonable share of income is between the two of you for tax purposes, even if you are 50/50 partners.
Own a business with your wife? They are going to tell you what a reasonable share of income is between the two of you for tax purposes, even if you are 50/50 partners.
And all of this so that lawyers and accountants cannot income split with their spouses.

The government is not doing this to clamp down on lawyers. They are already banned from the practice of income sprinkling.
The law will affect doctors, especially in Ontario (where the Ontario Government used income sprinkling to help doctors increase their income at the expense of the Federal Gov) and ALL small business owners where the business is run primarily by the husband (the bread winner) who sprinkles his income across his wife and children to reduce his taxable income (and yes, women do this as well).
Income sprinkling has a number of benefits including allowing children to attend university on less-taxed dollars. This allows a number of young people to graduate debt-free through help from the self-employed parents who issue capital gains.
As the government looks to close these “loop-holes” I find it hard to imagine how people (like me) will be able to save for their retirement when so much of their income is taxed at effectively 50%.
Luckily my accountant has a plan and it certainly doesn’t involve paying more taxes.

The Federal Government had earlier stepped in to create a mess with dividend income. If your child was issued a dividend over $30,000 for example, they were charged GST retro-actively.
One of my children was issued a business number by the Federal Government and then that business was charged over $4,000 in “missed” GST payments which took almost 4 years to resolve. For example, if she had to pay GST, she could just claim it back as having been paid and the CRA bill would net to zero. But a sizeable amount of the bill was in penalties for late filing (of non-existent GST payments).
CRA is going after small business owners because they believe these people are using tax loopholes. They are not going after large corporations which shelter taxable income offshore and this is the greater problem.
Take a little bit of money away from the minions and leave the big (well-lawyered) fish alone.
