In a decision hailed widely by those who live a safe distance from The Trade, Canada’s Supreme Court reaffirms that Canadians pelvic freedoms shall not be infringed.
Just don’t yell “whore” in a firehouse.

Legal businesses need licenses, inspections, regulations, insurance, can be sued and are subject to union organization.
Trying to understand how Seniority would work in a unionized whorehouse.
“I’d like the busty young redhead over there”
“Sorry buddy, but Mary has Seniority”
“Mary, put your teeth in, put your walker away and get over here, you have a paying client”
Tears of joy from the pimps and whores.
Just in time for Christmas !
I think that prostitutes would be more similar to casual workers, that do not require licensing, inspections, regulations or being unionized.
I think prostitution should be fully legalized, with regulations that parallel the oil industry… and see how long it takes before they demand criminalization.
Just imagine reading a 500 page report and agreeing to 290 “conditions” before you can lay a single piece of pipe.
Will the pimp now be called “shop steward” just askin’
Wait until the first SCC judge gets a nasty STD from some Friday night hooker moment.
The lawsuit will be priceless.
Apparently we in Canada are no longer free to decide, through Parliament, what moral values we can choose to uphold as a society. The Supreme Court decrees for us what our moral values must be. So we have a society where the state must provide safe injection sites for drug addicts, where we cannot (apparently) outlaw prostitution, we cannot regulate abortion, but we can nanny-state cigarette smokers to death and seize the cars of drunk drivers on the spot without due process.
And this was a *unanimous* decision to boot, even with a number of Harper appointees on the Court now.
*spit* Rot in Hades, Pierre, for foisting these judicial overlords upon us.
Perfect, we now have an excuse to open up the debate in the House and properly ban the practice outright.
Enough dilly dallying around the issue.
I told Harper that the problem had a simple solution.
Offences:
Exchange of sexual services for consideration as a business.(new)
Soliciting for the purposes of prostitution.
Operating a common bawdy house.
Living off the avails.
Of course no-one read the email.
Too easy – just make prostitution illegal.
Speaking of prostitutes – I see Barney Frank has joined CNBC as a contributor.
Waiting on the shiney pony to admit to it. The sex of the recipient to be left to the imagination
“…But it upheld the controversial legal concept of speech that is “likely to expose” certain groups to hatred…”
I patiently anticipate the first prosecution of the next NDP politician who employs such pejorative expressions as “American style…”
Somehow I think I’ll be waiting for awhile.
The beatings will continue until morale improves…as this ruling was ostensibly all about making the ‘oldest profession’ safer. I would have strong reservations about the profession ever becoming ‘safer’…not to mention the transmission of viruses and bacteria.
And no you will not be respected in the morning, because the ‘profession’ inherently involves sexploitation; which is all about disrespect. The profession is not sought out because customers are seeking a ‘long lasting relationship based on mutual respect’.
What the SCC is more interested in; TAXES, through ‘state pimping’ legislation and regulation…so there will be no free hookers!
Cheers

A great day for freedom. Canada just became more civilized. The SCC is truly the least-dangerous branch of government in the country. And no, this decision is not just hailed by those living far from the trade but by all people who actually want freedom, which, unsurprisingly, does not include the owner of this blog.
In my dreams, this ruling is used as precedent to strike down drug prohibition…
Off-topic: You read Alinksy? What happened to “Not showing up at a riot…”?!
The Supremes confuse freedom and license again.

LASsie, in my dream pimps buy the house next to your mom’s and sell dope and pu$$ie off the front porch. Using women kidnapped/bought from third world countries. Free BJ with every dime bag, gotta compete with the crack house down the street.
Somewhere, Omar the slave merchant is rubbing his hands in glee.
Better link here. http://www.anselmphilosophy.com/read/?p=7
Lets all pitch in a few bucks and open a brothel right next to Bev’s mansion. I sure she would appreciate being around so much “culture”.
We have Trudeau to thank for allowing non elected, and far too often judicial activists, judges to legislate instead of Parliament. Of course there is a lot more for which we can thank him such as official bilingualism and equalisation to reward lack of fiscal responsibility.
Why was prostitution formerly referred to as white slavery? Isn’t it all about freedom?
Funny that’s my dream too. Of course it wouldn’t make any sense for the pimps to even exist let alone import ‘slaves’ given that Canadian woman can now compete openly with protection of the law, thanks to our benefactors, the SCC. Omar is welcome too.
From the pimps much more. The actual prostitution wasn’t illegal anyway, so with a some care prostitutes could carry on their trade without running afoul of the law. For the pimps this ruling holds the prospect that they can eventually become free to exploit the prostitutes. And although the Supreme Court says the current law is illegal but can be enforced for another year, in practise the uncertainty will immediately take much wind out of the sails of enforcers.
If the goal was to reduce prostitution then it is another area in which prohibition has failed. Not only is there no proof of reduction but over the years it has become more socially acceptable (@scort services)and connecting buyers and sellers has become easier than ever in the communication age. All the laws did was make it more dangerous for hookers, how moral that is that?
Besides relying on a moral argument is giving a green light to progressives who use it to take away rights in areas they deem immoral. Conservatives should understand that consistently defending individual rights would give them credibility when arguing for the right to: guns, free trade, free markets, religious freedom, lower taxes/economic freedom, free speech etc.
A person can find an activity undignified and self-destructive but still argue for individual freedom. Municipalities should maintain the right to zone where such businesses operate. Adult entertainment districts that already have bars or casinos would seem like the obvious area. In fact, I’d bet a bar patrons would be more of a problem for cops than a legally operated brothel.

“I think prostitution should be fully legalized, with regulations that parallel the oil industry…”
I agree, it should be legalized, if anything to get guys like LAS off the streets and out of sight of our children.
You and I are in agreement. They should be held to standards similar to a doctors office. After all the procedures are about as invasive as anything a doctor is going to do to you.
And all clients need to provide full identification – the health risks absolutely demand it.
Once legalized those who practice the trade illegally should be prosecuted to the same extent as a doctor or abortionist who was acting illegally would be.
Note to the sex trade “workers” currently practicing the above is what’s known as Unintended consequences.
That panel of judges almost entirely appointed by Conservative/PC Prime Ministers?
Very funny reading the ‘male’ commenters on the Globe and Mail reacting with glee at this ruling. I guess when the only way they get to have sex is by paying for it, it makes sense they’d be giddy.
Of course if this would have been in place a few years ago it would have made Jacko’s paddy whacking incident legal, well legal if the hookers can be underage and illegal foreigners.
A fine decision, the oldest business in the world is now on par with politicians.
As George Carlin put it, sex is legal, buying and selling is legal, so?
This is another big government abuse.
Behaviour ordinances can only be local, acceptable behaviour is so subjective, hence standards can only be chosen at the community level.
But the kleptocrats insist we are not smart enough.
Therefore I feel Ottawa should test run open prostitution outside Parliament, a fine site as most voters could not tell the difference.
Outside all courthouses and in gated communities which house judges are also good sites for this behaviour.
Wonderful.
Now, prostitutes can be abused, demeaned, exploited and objectified on an equal footing with all other Canadians.
Thanks a lot, SCC.
A great day for freedom. Canada just became more civilized.
You can rent your body parts, just don’t sell your kidney…
“That panel of judges almost entirely appointed by Conservative/PC Prime Ministers?”
Doesn’t Harper know any lawyers that believe judges should interpret law, not create it? I do, they are not all assholes. Even electing a Conservative government gets a fascist anti-democratic bench. Other than the Liberals usually have a moron for a leader, is there really any difference between the major parties?

I must be getting old, come to think of it I AM getting old, but when a local escort advertised “$100 half hour specials” in the local free Paper, my immediate reaction was,”hell, I can buy two bottles of decent rum for that price”.
And, it’s okay to cry,”whore” in a firehouse, but NEVER cry ,”whore” in Parliament. 308 politicians will hurt their necks turning fast to see which one is being called.
No one will be left to run the Country.
First, Phil of Duck Dynasty tells us a woman’s vagina has more to offer men,
and then the Canadian Supreme Court tells us women can offer even more.
‘These are great days we are living in Bros.’
Men walking the earth with long guns,
and picking the women we want at night..
The Netherlands tried this already and they don’t like the results:
“Rather than afford better protection for the women, it has simply increased the market. Rather than confine the brothels to a discrete (and avoidable) part of the city, the s*x industry has spilt out all over Amsterdam — including on-street. Rather than be given rights in the ‘workplace’, the prostitutes have found the pimps are as brutal as ever. The government-funded union set up to protect them has been shunned by the vast majority of prostitutes, who remain too scared to complain.”
“Pimps, under legalisation, have been reclassified as managers and businessmen. Abuse suffered by the women is now called an ‘occupational hazard’, like a stone dropped on a builder’s toe. S*x tourism has grown faster in Amsterdam than the regular type of tourism: as the city became the brothel of Europe, women have been imported by traffickers from Africa, Eastern Europe and Asia to meet the demand. In other words, the pimps remained but became legit — violence was still prevalent but part of the job, and trafficking increased. Support for the women to leave prostitution became almost nonexistent. The innate murkiness of the job has not been washed away by legal benediction.”
“The Dutch government hoped to play the role of the honourable pimp, taking its share in the proceeds of prostitution through taxation. But only 5 per cent of the women registered for tax, because no one wants to be known as a whore — however legal it may be. Illegality has simply taken a new form, with an increase in trafficking, unlicensed brothels and pimping; with policing completely out of the picture, it was easier to break the laws that remained. To pimp out women from non-EU countries, desperate for a new life, remains illegal. But it’s never been easier.”

Free !!!LOL
That’ll be the day.
Doesn’t Harper know any lawyers that believe judges should interpret law, not create it?
When a law is unconstitutional, it gets struck down. That is how constitutional law works. Don’t like it? TFB
Deb: every word you said is BS. The Netherlands experiment works just fine (just as it is in New Zealand) unfortunately some idiots in their government are fabricating problems to justify their authoritarianism.
The new world is not going to work according to old and arbitrary ‘rules’. The new rules will either be social liberalism or social libertarianism. Make your choice and shut up.
g=G
(I was laughing to hard)
I know longer have any compassion or give a shit about missing hookers/women. I will never again donate to charities That have anything to do with women including but not limited to breast cancer, abused women’s shelters, women’s equality in the work place. I will no longer defend or protect a women in distress!!
You want equal rights by having equality in the work place but then undermine yourself as a human by making the subjugation and abuse of your bodies legal F58k you! you women are now on your own in my book. you are now my equal , I will never again pull over to help a woman change a tire, I will never again help a woman reach something , lift something, pull something, or carry something all of this is of course does not apply to my wife or any females that I father.
You fought to slaughter unborn children in your womb you got it, you fought to have your bodies used and treated like a piece of meat you got it don’t ever come to me for help , you are on your own I am done with this sh!t.
As a man I cannot believe women who claim to want independence and equality etc. etc. are the same women that are calling for the abuse, and mistreatment of there bodies and the enslavement of there fellow females ! its truly the work of the devil at work here and to that I will turn my back and let you rot I will now be on a crusade for a private health care option because that is what they are going to go after next is a constitutional right to free health care for the disease treatments drug addictions and abused and aborted children they kill or give birth to.
shame on women ,every last one of you. and the men who also support this garbage.
You are all gonna reap what you have sown.
Well, we all get what we want then eh LASsie? Have fun cleaning the used condoms and needles etc. out of your Mom’s flower garden, maybe keep an eye on Mom and other female relatives when Omar the slave merchant is around. Never know when a cousin might go missing, know what I mean?
By the way, did you know the average pistol bullet can easily travel completely through two modern suburban houses before stopping? Might want to think about that little datum when considering who you want for neighbors. Their little spats can become your problem rather suddenly.
“The brothel boom is over. A third of Amsterdam’s bordellos have been closed due to the involvement of organised criminals and drug dealers and the increase in trafficking of women. Police now acknowledge that the red-light district has mutated into a global hub for human trafficking and money laundering. The streets have been infiltrated by grooming gangs seeking out young, vulnerable girls and marketing them to men as virgins who will do whatever they are told. Many of those involved in Amsterdam’s regular tourist trade — the museums and canals — fear that their visitors are vanishing along with the city’s reputation.
…
The day after the Amsterdam zone opened, more than a hundred residents from nearby neighbourhoods took to the streets in protest. It took six years for the mayor to admit in public that the experiment had been a disaster, a magnet for trafficked women, drug dealers and underage girls. Zones in Rotterdam, The Hague and Heerlen have shut down in similar circumstances. The direction of travel is clear: legalisation will be repealed. Legalisation has not been emancipation. It has instead resulted in the appalling, inhuman, degrading treatment of women, because it declares the buying and selling of human flesh acceptable. And as the Dutch government reforms itself from pimp to protector, it will have time to reflect on the damage done to the women caught in this calamitous social experiment.”
And LAS demonstrates he is a complete idiot and can’t abide any information that doesn’t conform with libertinism…
LAS = Libertines Are Supercilious

Your comments are worthless Phantom. The world you are describing won’t exist in a year. Legal businesses don’t operate that way. Why do you support violence Phantom? Why are you so violent.
Paul: there’s an outfit in Afghanistan with similar views as you. Look up ‘The Taliban’.
Hans: The brothel experiment sounds like it has had problems because it is so legally restricted and spatially restricted to only one part of the city. The brothel boom is not over it’s coming here. Get used to it and let freedom ring.
It’s also worth pointing out that New Zealand has no problems with its legalization experiment. We win you lose.
Since prostitution is now legal it can be taxed and regulated by government. I think that between them the taxman and the workplace safety bureaucrats will be more effective at suppressing prostitution than the vice squad. Can you imagine the amendments to the Occupational Health and Safety Act? Would city bylaws regarding street vendors apply?
Hookers and pimps are now about to enjoy the fruits of this ruling.
They will come to appreciate Ronald Reagan’s warning:
The nine most terrifying words in the English language are “I’m from the government, and I’m here to help.”
Thanks, Hans. Says it all.
Leftist policies hurt women.
