A state judge in Pennsylvania has dismissed an assault and harrassment case against a Muslim defendant who admitted attacking the victim. Magistrate Judge Mark Martin, a veteran of the war in Iraq and a convert to Islam, ruled that Talag Elbayomy’s sharia defense — what he claimed was his obligation to strike out against any insult against the prophet Mohammed — trumped the First Amendment free speech rights of the victim.
Yes, you read that correctly.

    That ruling is unconstitutional….full stop!
    Nothing to see here….the “judge’s” days on the bench are numbered.

    About as long as a typical snowfall in July lasts in a high desert.  I think the word “doofus” should be applied to the judge, not the victim…

  5. Presumably the judge swore an oath to uphold the laws of the USA and the Commonwealth of Pennsylvania when he became a judge.
    The decision clearly puts him in violation of that oath.
    Sounds like treason to me.

  7. Recall the failure (Oklahoma?) of that proposed bill to to outlaw the use of shari’a law in the American “justice” system.
    Apparently, the bill was poorly drafted. Maybe, but still!
    Recall also libertariansaresmarter’s contemptuous dismissal of the threat of shari’a in the US. Dismissers (I daren’t say deniers) fail to understand that we worriers don’t expect there to be a BIG ACCOUNCEMENT of it’s commencement on a specific date in time, say April 1.
    It’s incremental, unrelenting. Day after day, week after week. This is actually the Muslim Brotherhood’s conscious tactic.
    Again, my big takeaway from Efraim’s Karsh book on islamic imperialism was the active collusion of the civil and clerical elites (who know which way the wind is blowing).

  8. Don’t forget that this judge is presiding in Pennsylvania. People in the Philadelphia and Pittsburgh areas don’t even know what the Constitution is. The others are sticking to God and their guns and they don’t matter.
    I’ll bet the judge stays on the bench. I’ll be that Talag Elbayomy will be watching out for his life.

  12. Who’d of thunk that total ignorance of constitutional law would not be an impediment to someone becoming a judge? Maybe the judge was just trying to better his chances of winning the moonbat of the year award. It’s too bad that the authors of the US constitution didn’t have much experience with islamofascists as they probably would have put language in the US constitution prohibiting them from coming to the US unless they attained civilization. Having a fanatical group which is backward even by 7th century standards in a modern country is a recipe for disaster.
    Full points to Ernie Perce for mocking islam although I’d suggest that he get his CCW and be packing next time he appears in his Zombi Mohammed costume in public. I’d love to see how a superior court is going to shred this idiotic ruling.

    Their goals may be different but their intent is the same. They have also been winning, which is why this “judge” will most likely worm his way out of any consequential consequences.

  14. I no longer have faith in the judicial system; Lady Justice now peaks from under her blindfold to have a good look at the skin colour/creed of the accused and aggrieved. And just look at the stupid comments recently made by Supreme Court judge Ruth Bader Ginsberg regarding the worthiness of the U.S. Constitution.
    I bet this judge and ruling stays and we see more of this in the future.

The Muslim Judge is taking his lead from the POTUS who has just finished kissing Karzai’s ass as an apology for the US troops who burned the (already defaced by Jihadist prisoners) Qurans while cleaning-up. The ensuing riots have so-far killed 2 US soldiers. Anyone out there who still thinks Afghanistan was a good idea?
    Islam is as much a part of the institutional left as Suzuki is to US corporate foundation money. The reason is that Islam couldn’t be more anti-Christian if it were run by Satan himself (which, if I believed in such things, would be entirely plausible).   16. Yup, it’s the Chinese water torture method: one drip at a time, over and over and over and over. . . There are lots of us who cottoned onto this a long time ago: every new drip feels like a hot iron being poked into one’s head.
    But the useful idiots simply think it’s a spot of water to be ignored. I’ve got a lot of them in my own family: the ones, who have loads of money and are quite insulated from on-the-ground Canada, tend to be PC and, though very well educated, are woefully ignorant of what’s really going on. Did I say such people are idiots?

This was witnessed by a couple who stood up for Menzies, when he reported it to a nearby police officer. In effect, the officer said, “’Nothing to see here. Move on.”
    Afraid of being called out for being racist, teachers, administrators, judges, and all kinds of other public officials turn a blind eye to Muslims breaking rules all over the place. It’s truly scary. And by the time the useful idiots catch on, it’ll be too late. Kyrie eleison.

  17. Not 100% sure that Judge Mark Martin is Muslim. He is definitely white bread, and does appear to say in his audio during court proceedings “I’m a Muslim and I find it offensive”. That said he does refer to Muslims as “they” frequently.
    Regardless at the very least he’s a red diaper doper baby to the core of the mentally ill liberal left.

    He doesn’t seem to think that Christianity (at least at one time) was a culture worthy of special treatment. Even if he was correct, when did “culture” become an acceptable excuse for physically assaulting someone of another culture in the US? Why is Islam the only culture excused from assaulting other cultures for offensiveness via free speech?

  18. Anyone find it plausible that Talag Elbayomy actually didn’t know that depicting Mo isn’t illegal in the U.S.? If so, one might almost question the rigour of the immigration screening process.

  19. Because if he’s the same guy as “Talaat Bayomy”, of Mechanicsburg, Pennsylvania, then he’s been in the country since at least 2000. I think he should be a bit better aquainted with our quaint little customs by now, like our not being under Sharia law and all that.

  23. I agree with you, Scar. In your comment, you refer to the “separation of church and state”.
    You may have touched on the real issue in today’s world.
    There is a concerted effort to make sure that “church” is kept separate. The problem is that there seems to be no similar effort , to separate “mosque and state”.

    I wonder, is he another convert to Islam or just one of the “useful idiots.”

    Agreed, the separation of church and state does get many of Christians noses out of joint. They fail to recognize two fundamental points.
    #1. In a democracy we may have an Islamic majority one day.
    #2. (Most importantly) Separation of church and state is primarily to keep the State out of YOUR religion, whatever it may be. Not the other way around as so many arrogantly seem to think.

    Which means his judgment was biased not because of his religion, but because like most judges nowadays he’s a left-wing pinhead.

  27. This is why I no longer vote. The only solutions to the West’s problems lie on the battlefield. I have no interest in waging war, ergo I shall be forced eventually to convert to Islam. Come to think of it, why should that be a problem for me? I’m a conservative, productive, heterosexual male. I’ll be just fine as a Muslim. Svend Robinson,…. not so much.

  28. Interesting information. As it unfolds, it sounds like the Judge acted well withing conventional norms. Amazing what can happen when we get both sides of the story. Does not sound like the Zombie was actually attacked and hurt.
