    Maybe if youth were to realize that there are consequences to their actions, they would think twice. But then, there has to be consequences.

  7. As a father of a young woman, I find those comments completely offensive. OK fine reduce the sentence, but I then reserve the right to seek justice in my own way without prejudice.

    I think I am gong to be waiting a long time, particularly on the second point.

  10. I doubt he’ll be turfed because nothing he said isn’t Liberal. To a Liberal, the rapee is a member of that society that has caused the perpetrater’s poverty and disadvantage, hence can’t be construed as an innocent victim. So, there is mitigating circumstance.

    Thus the inability to give consent is translated as tacit consent…that is just moronic.

  15. For a guy who was a judge, he doesn’t express himself very well.
    Crimes have minimum sentencing requirements because if they didn’t, Liberal judges would make a complete mockery of justice.
    All one has to do is look at the maximum sentencing requirements on major crimes and how they are applied to know just how much of a mockery of justice Liberals want to make in our society.

    Harper’s war room should be absolutely hammering the Libs and emphasizing the CPC’s “tough on crime” stand. Actually, they should be hitting harder on many points such as our economic track record & standing within the G20, an attempt to add up the cost of the pie-in-the-sky Iggy & Layton campaign promises and the fact that hostile policies directed solely t one industry (oil) will bite the hand that feeds. Is it just me or do others feel that the conservatives are not fully capitalizing on these opportunities?

  20. Conservatives should be hammering away at the cap & trade portion of the red book. Call it the mother of all eco-taxes and Ontarians will flip. They were quite vocal when the provincial libs tried to implement a tax on a myriad of items with dubious claims of proper environmental disposal. I dare say that could send us into majority territory.
    It “killed” Dion, why should this be any different?

    This “disgusting” candidate, as labeled by Ignatieff himself, in Wild Rose will continue to be on the Liberal team, and remain an advisor and confidant for Ignatieff on crime legislation
    Ignatieff said he was “disgusted ” by the comments of Liberal candidate John Reilly in Alberta, who is poster child for Liberal policy of tough on crime, who suggested not all sexual offenders deserve to go to prison.
    “These remarks are utterly ,totally unacceptable. We find them, in fact disgraceful” but Iohn Reilly will remain a member of the Ignatieff Liberal team in this election. Nobody on Liberal team will question this decision because as Ignatieff has told Canadians “only I speak for the Liberal party” and this makes sense to him.
    Is it any wonder now that the new Liberal crime policy will require no jail cells?
    Only yesterday we learned of another disgusting member of the Liberal team (even by Liberal standards) Andre Forbes, who has been a Liberal candidate in Quebec, since August of 2009.

  24. Read the Criminal Code definition of sexual assault and the cases that give meaning to the statute. Sexual assault is any unwanted sexual touching, viewed objectively, that undermines the sexual integrity of the complainant and for which an explicit consent is not given (Ewanchuk: it’s not “no means no,” but instead “yes means yes”).
    The offence thus encompasses anything from a pat on the bum all the way up to rape.
    Are you guys seriously taking the position that ANY sexual assault should be punished with jail time?
    As the judge said, there’s sex assaults and then there’s sex assaults — kind of like how shoving someone by the shoulder (assault) pales in comparison to punching them in the throat (also assault).

    Then your argument needs to be with the government’s definition, not the minimum sentencing time, doesn’t it idiots?
    In the case we’re talking about here I would hope that penetrating an unconcious women would be taken seriously by you if not by the Liberal judge who used an example from his bench that goes far beyond a pat on the bum as an example where he didn’t think jail time was warranted.
    Just so you know, the current definition was demanded by Feminists(a constituency that the Liberals consider to be part of their core) as well as the minimum sentences.

    I do not disagree with his opinion that a person’s background should be taken into consideration when sentences are meted out.

    I strongly disagree that a person’s race should be a factor. Reilly’s opinion was subverted and taken to a level that was (IMHO) not intended. However,he did not clarify the original intent,in fact ,he revelled in the attention.

    Back in the days when I was younger,and a bit wilder,his name brought a smile to defense lawyers and their clients.

    As someone who worked for over 30 yrs,in a ‘caring’ profession,I have had direct experience with victims of sexual assault,and I am really,really horrified by this..more so by that stupid,braindead Oliver.

    Does he say he wants to redefine sexual assault into categories as murder is: 1st Degree, 2nd Degree, 3rd Degree each with it’s minimums and maximums?
    No.
    He wants to do away with sentencing minimums and keep the BS definition that the Liberal Party created in the criminal code.
    He is quite clear that what he wants is to give community service to a man who sexually penetrated a non-consenting unconsious woman.
    Typical Liberal, wants to keep the Feminist Liberal constituency happy with the BS definition of sexual assault while pulling the teeth from the sexual assault law in general.
    Why is that?
    Could it have anything to do with the fact that Jean Chretien’s son was a convicted rapist and he got an exceptionally early release and this laxity on sexual assault in general in the LPC follows from so many Liberals having to defend that?
    So what if this Liberal candidate doesn’t get elected MP.
    Having been a judge and just running for a hopeless seat is enough to put him on the Liberal Senator-for-Life list.

    there really are a lot of of hapless hopeless dipshits out there…who ain’t crims as I know them…they fuck up one night because of drugs or booze and get a fistfull from the law…
    nope…ain’t right…ain’t fair…even a dog gets parole after biting just oncet.
    doesn’t mean i’d vote for the bleeding heart though…
