Jason “my law degree DOES NOT smell like Crackerjacks” Cherniak ponders his options….
I could start up a donation link on my sidebar and hold the money in trust, but I don’t want to try it only to find out that people aren’t really interested. I also don’t want to seem like a whiny person who wants everybody else to protect him. I think the answer is to put it all out there, as I have above, and let my commenters and other bloggers express their opinions. Hopefully, such an online brainstorming session will have some benefit no matter what the general view is.
Your eyes aren’t deceiving you. A lawyer is considering soliciting donations from his readership to pay the bills on a libel suit. Not a suit he’s defending himself against – a suit he’s threatening to file.
Because he can’t afford a lawyer.
He does not volunteer how the spoils might or might not be divided should he prevail.
Part of me hopes he goes ahead with this. The precedent could prove quite useful around here.

No, you spilled it on your diploma, which is a piece of paper that documents or evidences your degree. But it is not the degree itself, which is incorporeal.

He’s threatening to sue a chick because she insulted him? Called his law degree Crackerjack in a way no reasonable person would ever think was intended to be real? Said an over the top, frankly stupid comment, about Cherniak not being smart enough to be Jewish?
Now I’ll be the first one to say Shaidle isn’t my cup of tea. She always comes across as a bit of a self-righteous cow, frankly. Confident and right three quarters of the time; I’m sure we’d agree on most issues and vote the same, but she’s obnoxious and is equally confident when she’s dead-ass wrong.
But she’s not a little p|_|ssy who’d sue me over my opinion: She’d insult me back or ignore it, just like Jason should.
The Jewish comment I’ll admit was offensive and part of why I don’t like Shaidle much. Yes it shows she thinks Jews are often smart; I don’t think she’s an anti-Semite. But it’s an unnecessary thing to bring up; there’s no good that can come of it. I think she should apologize and I don’t think she will.
But defamation of character? Saying she doesn’t think Cherniak’s smart or a very good lawyer? Come on. These are widely help opinions, to start with.
Even though Jason has been nice to me when we weren’t actually debating and I have nothing against him, and sometimes I’ve even agreed with him on moral issues like Israel’s right to exist, I’ve frequently been highly critical of him on his blog especially before he started moderating everything. We’ve debated. It got heated. My goal was to show him and everyone else he was totally wrong, which during his cultlike devotion to the widely flailing Mr. Martin was easy.
If and when you read this, so what, Jason? You going to sue me because I said you were wrong, not particularly bright where your blind and oft-admitted partisanship is concerned, and devoted to the former Prime Minister in an irrational way? In my opinion?
YOU chose to be a public figure by publishing a blog and getting involved with politics! People are going to be critical of you and some complimentary. It’s what you get for playing the game.
Take the bad with the good. Shaidle has one but isn’t one. A.k.a., don’t be a p|_|ssy in her place. It’s embarrassing.
As one guy to another, it’s just weak. You’re making her look good by comparison and that’s your fault.
I made an error in reading Cherniak’s post. I thought both comments were from Kathy Shaidle. I see the one which I thought was dumb, the Jewish one (even though in no way, shape, or form is she an anti-Semite… and I don’t think she defamed Cherniak’s character) is Shaidle’s.
The other one, completely innocuous, is from Blazing Cat Fur.

I didn’t say I sort of admire her. I recognize that she’s not a weak person.
In some ways I admire Cherniak. Only in some ways. He’s a good organizer, for example, and that’s a real talent. I just don’t understand why he engages in a public debate taking a prominent role unto himself, and threatens to sue when he’s merely insulted.
That’s life.

How lame, if I wanted to call you a derogatory name I simply would use and ‘*’, as an example: pr*ck or d*ckhead or such what, and not come up with a lame excuse of spam filters.

Hardly a cogent opinion. Over-the-top describes all of this.
Kathy needs to perhaps chill some, be a bit more sublime a tad more cerebral , Jason needs to step back from the mirror and ask himself. “Just who the hell do I think I am?” (And recognize that the Great Litigator only offered him 500 bucks. Pays for an hour and 20 minutes at downtown rates. Hardly enough to get you past the first consult. All very telling- BCL, despite the big mouth, can only offer a small amount, maybe he needs to spend more time actually hustling real estate than benefiting us with his wisdom and insight).

No, Skip, I won’t. The Rat, someone whom I respect, mentions there are other reasons he finds others of Shaidle’s posts disgusting. I agree based on my quite limited reading. He would be able to better give you examples since he’s a more frequent reader.
Saying, “You’re too stupid to be Jewish,” IS offensive and DOES earn her the cow title in my book.
That doesn’t mean I hate everything about her. In fact, I’d probably like her more than your average syrrupy liberal because at least she doesn’t support inserting a needle in a babies brain inside a selfish woman’s vagina.
So, when I think about it, I’d like her a WHOLE lot more.
But… she can be obnoxious and what she said about Cherniak isn’t nice. My point to him was she doesn’t have to be nice. It’s a free country, or should be. She didn’t defame him and his legal offence fund trial balloon is hilariously dense, as are many of his ideas.
Maybe he should get a grant from the damnable taxpayers for it.
