The interesting thing about this is that the judge clearly wanted to do something, but everybody involved, including CPS and the prosecutors, was collaborating in the fiction that the girl was 16 and therefore out of the court’s jurisdiction.

John – rather think this is somewhat of a simplification. Back in the day, if an Indian man married a white woman, she gained Indian status. Conversely, if an Indian woman married a white man, she lost her Indian status. The result was that a lot of Indian women stayed “common-law” with white spouses in order to maintain their status, resulting in a lot of blue-eyed Indians. Finally, those women who had lost their status sued to have it returned and eventually the courts agreed, which meant the women and their offspring had the right to return to the reserve and obtain housing, etc. This was met with considerable resistance, not only by the Indian men (who may or may not have had white spouses who were now “status”) but by others on the reserve who were competing for scarce housing, etc.
