This afternoon the Supreme Court agreed to review the Colorado Supreme Court decision disqualifying Trump from appearing on the state’s ballot in the 2024 presidential election, under Section 3 of the Fourteenth Amendment. The case will be heard on an expedited schedule, with oral arguments scheduled for February 8, a little over one month from now. The justices likely chose to hear the case quickly so as to make sure it gets resolved before we go too much further into the 2024 election cycle.
Significantly, the Court has not limited the questions presented. That means the justices could potentially consider the full range of issues raised by the case, including whether the January 6 attack on the Capitol qualifies as an “insurrection,” whether Trump’s actions amount to “engaging” in insurrection, whether the president is an “officer of the United States” covered by Section 3, whether Section 3 is “self-executing,” whether it is a “political question,” and whether Trump got adequate due process in the state court. There may be some additional procedural questions, as well. But perhaps the Court will issue narrowing questions presented before briefs are due.

The most interesting conspiracy theory I’ve heard to date that actually has some credibility to it, is that the main objective of the disqualification movement is not merely to disqualify trump. I think grifters like Jamie Raskin knows that the 14A s3 argument can’t hold water, but what it will do is give Raskin and the demon-crats justification to discredit SCOTUS, and make them less relevant in the eyes of the public. If SCOTUS overrules Colorado SC, then the left (demon-crats) will use this as ammunition to claim that the court is anti-democratic.
It’s all part of the over-all strategy to destroy the republic so that the left can rebuild the country in their own sick and twisted dystopia.
Either they get Trump off the ballot or they get the consolation prize of ‘proof’ that the SC needs to be packed because ‘Our Democracy’.

No person shall be a Senator or Representative in Congress, or elector of President and Vice President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may, by a vote of two-thirds of each House, remove such disability.
President and Vice-President are missing from Section 3 of the 14th Amendment. There are several issues to be discussed: whether or not the riot should be classified as an insurrection by a competent legal authority such as a court, whether or not Mr. Trump “engaged in” or “given aid or comfort to” and other issues.
But one of the main issues that the SCOTUS will need to rule on is whether or not Section 3 of the 14th applies to the President and Vice-President. I can see the arguments for both cases. On the one hand, both positions may be included in the phrase “or hold any office, civil or military, under the United States, or under any State” as the Colorado Supreme Court stated (any office). On the other hand, why specifically mention Senator or Representative in Congress without specifically mentioning the two positions of greater power and authority unless it was intentional? Furthermore, if a 2/3 vote by Congress may remove such disability (a somewhat national democratic action), why cannot a vote of the citizens of the country also remove such disability (a clearly national democratic action)?
If SCOTUS rules that the two positions not mentioned were intentionally left out, it will essentially be ruling that the purpose of Section 3 of the 14th Amendment was intended to prohibit the voters of individual states from influencing the decision of who holds certain positions but it was not intended to prohibit the voters of the entire nation from influencing the decision of the only two positions which are actually decided by the voters of the entire nation. Such a ruling would be more consistent with the entire constitution: “We the people…”

If the SC rules in favour of removing Trump then they are ipso facto convicting him of insurrection. For any of the 14As3 to apply the insurrection criteria has to be met.

It hinges on the fact that 14 (3) doesn’t say “convicted”, it says “engaged in”. It’s a bit murky.
It’s no murkier than you want it to be. You are a public servant, entrusted by the public to ensure that the election is properly run. You must therefore refuse ballot space to the unqualified. Those who have engaged in insurrection are unqualified. Who are they? Well, anyone who has been convicted of insurrection obviously. Who else? Anyone who actually has engaged in insurrection. Not, anyone it amuses you to accuse of insurrection.
So, there are grounds to hate Donald Trump, God knows people do. There are grounds to lie about DT, as we know people do. Are there any grounds whatsoever to believe that Trump actually engaged in insurrection? Anyone who says yes is plainly lying.
