I remember that as recently as the early 80s, the Canadian legal custom was that illegally obtained evidence was perfectly admissible in courts. But I think the RCMP went so far down the road of wrongdoing that things moved in the direction of the Americans’ “fruit of the poisonous tree” concept.
Well, the rule was that conclusive evidence, that actually proved the guilt or innocence of an accused, was always admissable no matter how obtained. Evidence of probative value, which did not however resolve the case, could be excluded if using it would do more harm than good, as by seeming to reward a dishonest prosecution. The Charter expanded the power to exclude, so as to allow openly dishonest findings from any court that needed to produce one. They were not worried about the RCMP, they wanted the Charter to ape the American Bill of Rights and the criminal practice as seen on American TV.
