Two sources familiar with the case confirmed independently to CBC News that Supreme Court Justice Glen MacDougall has ruled the cyberbullying law must be eliminated right away — unlike other court decisions that have struck down legislation but offered politicians a one-year grace period to rewrite the laws.
No one is bullied online without their consent.

“Bullying”…..the new leftist word for someone bringing up points they do not agree with. You see it all the time. The NDP in Alberta has been whining about being “cyberbullied” during the Bill 6 debacle. The simple truth there is no entity on the planet that is a bigger bully than leftist governments. And I mean REAL bullying.

The Rehtaeh Parsons’ case led to a lot of bad law. They managed to convict a couple of poor kids for kiddie porn by agreeing to no penalty. Not in a million years could they have otherwise gotten a conviction. The poor girl made a bad decision while drunk and couldn’t handle the consequences while sober. It is a tragedy but largely one of her own making. I knew a girl in high school 50 years ago who reportedly had sex voluntarily with 18 guys on one occasion and it didn’t seem to harm her popularity. I was never a bully or significantly bullied but my impression is that, in a lot of cases, victims encourage bullying by their reactions.
We already have laws for stalking and criminal harassment.
She certainly made a “poor decision” while too drunk to make decisions and getting drunk was a bad idea, too. She wasn’t the only one in that incident making poor decisions and some of the others involved decided to hurt her for their own amusement. For that they got consequences that seem much lighter than hers. She could not have made that tragedy entirely on her own, they helped largely to make it.
The behaviour of the victims often attracts bullying but it would be a rare case that I would describe that as “encouraging” it.
Her parents failed her. The parents of the boys who used her and published pictures of it also failed her and failed their sons.
If she had deleted her facebook account how would the bullying have continued?

Why was she any less guilty of seducing the men than they seducing her? All had been drinking illegally and by all accounts the sex was voluntary and sought by the “victim”. Why is there a sexist assumption that men are responsible for sex? Remembering back to my youth, I don’t recall ever having sexual relations when I wanted, despite the begging. It seemed to be when a women wanted it.
Excellent points, Tooner. It appears true that Ms Parsons made choices that made her extremely vulnerable to harm, but nothing that she did exculpates those who harmed her. To be sure, one is more at risk of being robbed if one leaves the door unlocked and the window open, but the robber is not one bit less guilty for having committed the crime.
I don’t know if there was any seduction or, if there was, who did what proportion of it. But if the boys were forced to have sex with her, forced to take pictures, or forced to publish those pictures, I haven’t heard any reports of them complaining about it. Have you?
I agreed with you, she made decisions that caused her trouble. But I also say the boys had choices too and their choices made her consequences worse than they would otherwise have been, and if they hadn’t made the choices they did the boys wouldn’t have had ill consequences of their own.
The law that came out of it was a bad idea because this isn’t something that can be prevented or afterwards solved by laws. All the parents involved failed to condition these kids to behave well.
It’s never going to be the way of the world that everyone will learn to not make these mistakes. It should never become the way of the world that we don’t call it what it is.

I raised 4 girls, have 3 granddaughters that have went through that age, and friend who has a 15 year old daughter. Often as not, it’s the girls dictating the “action”. As to kids now days, most have never been taught “discretion” of any sort. A few years ago I was asked to “chaperone” a party. Mothers were dropping of 15 -18 year olds with LCBO bags full and just acquired. After 15 year old ask me to bed her, I bailed. My 3rd oldest GD was 14 at the time. No, from everything I’v read on this case, the girl was the instigator, and Kate points out, computers don’t turn on there own power and load up social media. I feel there is a matter here that has never been talked about, and that this non-bullying event may or may not have been a trigger event.

Nobody raped her. Nobody used her. Nobody harmed her. A bunch of drunk kids had sex, that is all. She was young, drunk and in search of cum. She got what she asked for. Then she could not have handled her regrets – her problem and none else’s. The fact that other kids who just as enthusiastically as her participated in these activities were later drugged though mud and into court is the real disgrace here.

If there was no charges laid if she did not go to police if after she killed herself then then media decided to seek “justice” on her behalf as tragic as this is no crime was committed under Canadian law.

No matter how much I begged as a youngster I needed her consent and when she gave me the green light the woman or girl my age at the time indicated she was ready willing and able …..no foul. I have 2 daughters and I will bring up this case to them and explain to them what happens and how to avoid it. And yes I was bad as a teen aged boy I had no parents no guide just friends booze drugs and parties and I partook in a few threesomes and other types of sex acts and not once was the female EVER forced or co hersed . In fact I remember very vividly a female friend decided to liberate herself one night and literally pulled me and my best friend into a bedroom with her and her exact words were “I’m all yours boys” and she grabbed my junk and started to kiss my buddy ….don’t ever tell me women are soft dainty innocent little creatures that just innocently fall onto male body parts.
The above sequence happened 3 times with 3 different wormen ….oh yeah and a sleep over with my buddy and our girlfriends turned into a sharing 4 some too at the initiation of you guessed it …the girls women are just as kinky,dirty,horny and sexual as men.
It’s funny the football team always knew the same 3 girls to invite to parties and round ups and rookie night. Heh heh.

regarding the Amanda Todd case, again, many of the events were her doing and hers alone. The family moves to escape the harassment and sure enough, she’s back on social media, and was sexually active at 13, etc etc.
what can be done? with kids that REFUSE to listen to sage advice and proof to support it? deeply entrenched biological urges are at play coupled with the recklessness of yout’. daredevils, gangs, extreme sports, formula car racing, air shows, mountain climbing during avalanche season, etc etc etc. people inherently believe THEY are exempt from the laws of probability.
