In the scheme of things, you might even say that Shema Jastaina’s ten-lash sentence was pretty darn moderate. Certainly the thirtysomething driver got off easier than Khamisa Mohammed Sadawi. The Supreme Court’s Insite decision, every ugly word, is here: http://scc.lexum.org/en/2011/2011scc44/2011scc44.html
This ruling is arrogant and irrational, and is potentially highly destructive to the rule of law. It is judicial activism at its worst.
Judicial activism is not always unjustified; there is nothing wrong with the concept of checks and balances to make sure legislative bodies don’t go too far. But this case, as Vriend of 1998, attempts to conjure up something that is not there, out of thin air.
The two clauses in question are found in the Controlled Drugs and Substances Act:
4. (1) Except as authorized under the regulations, no person shall possess a substance included in Schedule I, II or III.
56. The Minister may, on such terms and conditions as the Minister deems necessary, exempt any person or class of persons or any controlled substance or precursor or any class thereof from the application of all or any of the provisions of this Act or the regulations if, in the opinion of the Minister, the exemption is necessary for a medical or scientific purpose or is otherwise in the public interest.
Section 4(1) was upheld, but the Court ruled that the Minister of Health, in not granting the permit, violated the Charter section 7 rights of the claimaints.
Para. 92: “To prohibit possession by drug users anywhere engages their liberty interests; to prohibit possession at Insite engages their rights to life and to security of the person.”
This interpretation of Charter rights is wacky, to say the least.
If it is valid to prohibit drug possession because use is dangerous, it makes no sense to claim that using it in a slightly less dangerous way is protected for health and safety reasons under the s.7 rights to life and security of the person.
To say that drug users should be exempt from the criminal law because they seek health care while injecting is like saying that a speeding driver should be exempt from the road laws because he’s wearing his seatbelt. Most of us would agree that this would be preposterous.
Is a holdup man exempt from the Criminal Code if he uses the cash for health care (or to acquire drugs to take to Insite?), or because he has an “addiction” to crime?
Para. 127: “I conclude that the Minister’s refusal to grant Insite a s. 56 exemption was arbitrary and grossly disproportionate in its effects, and hence not in accordance with the principles of fundamental justice.”
And para. 140: “The conclusion that the Minister has not exercised his discretion in accordance with the Charter in this case, is not a licence for injection drug users to possess drugs wherever and whenever they wish.”
It is difficult to read this decision any other way.
Under its logic, there are no circumstances in which a denial of an exemption cannot violate s.7. The minister now effectively has no discretion at all. As with Askov, 1990, the floodgates will surely open, and the Court will act surprised that drug users and lower court judges took their decision at face value.
And that essentially negates s.4(1), which means the Court has contradicted itself. Legalization has come in through the back door.
The decision basically enacts former SCC judge Louise Arbour’s dissent in Gosselin, 2002, in which she stated: “Section 7 imposes a positive obligation on the state to offer basic protection for the life, liberty and security of its citizens.”
Can a requirement for the state to provide addicts with clean drugs be far behind?
I have always believed that the true goal with Insite was to waste tax dollars in as cynical a way as possible. Nothing has changed my mind.
Para. 150: “In the special circumstances of this case, an order in the nature of mandamus is warranted. I would therefore order the Minister to grant an exemption to Insite under s. 56 of the CDSA forthwith. (This of course would not affect the Minister’s power to withdraw the exemption should the operation of Insite change such that the exemption would no longer be appropriate.)”
(Mandamus basically means “get on with it”, applicable for situations where governments are stalling and action is required. Apparently it can apply even in cases where a discretionary action has become a mandatory one.)
First of all, exactly what are the “special circumstances” of this case? The ones that give drug addicts more rights than the rest of us? The decision does not make this clear.
What happens if the exemption is granted then immediately rescinded?
How would the Court have ruled, in the absence of all the alleged evidence of Insite’s efficacy, if it had never existed in the first place, and the activists wanted to open it? The Court should really be ruling as it would under those circumstances.
Perhaps the worst aspect of the decision is the possibility that, if the courts can order ministers of the Crown to make specific discretionary decisions, it is not such a big leap that they may believe they can order the governments to pass specific legislation.
Another problem with the ruling is that courts and judges should assume that people obey the law, with the exception of those brought in front of them who are charged with breaking it specifically. To facilitate breaking the law is cynical and rather contemptuous of humanity — even though we know there are lawbreakers out there.
The only good news is that the appeal court’s dangerous ruling, which stated that provincial enactments for health care are immune from the federal enactments of justice, was cast aside.
Parliamentarians should not be groveling by saying that they will comply with the ruling. They should say that IF they choose to comply it will be under protest.
Personally, if I were health minister, I could not in good conscience sign the order; I would resign instead.
What solutions does the government have at its disposal?
1. Invoke the notwithstanding clause of the Charter of Rights, s.33. It is applicable because the judgment is based on s.7 of the Charter.
2. Repeal s.56 in its entirety. This probably goes too far.
3. Amend s.56 to replace “medical purpose” with “medical treatment”.
Facilitating shooting up is not “treatment” of addiction, nor is doing it in a place where the goal is allegedly to encourage seeking treatment, any more than going on a waiting list is “health care”, as per Chaoulli, 2005.
4. Cut health transfers to B. C. dollar for dollar – at least this would put B. C. taxpayers on the hook.

“Climate change economic and non-economic impacts before adaptation are captured as a proportion of GDP by the climate change damage function. As do all the other main IAMs with the exception of MERGE, damage is defined as a non-linear function (Bosello and Roson, 2007). Welfare impacts (WI) are expressed as a polynomial function of the difference between regional and tolerable temperature levels (RTT) as follows:
WI(t, d, r) = [RTT(t, d, r) / 2,5 ^POW ] * W(d, 0) *[WF(r)/100] * GDP(t, r)
where t corresponds to time, d identifies the damage type (economic, non-economic, sea level rise) and r the region; 2.5 are the °C corresponding to the tolerable increase in temperature due to global warming; POW is the power of the polynomial impact function; W(d, 0) is the impact in the focus region (i.e. EU) at 2.5 °C and WF(r) is the regional weight applied to EU impact to calculate the impact in other world regions. SOURCE”
“Another reference gives the exact same equation for the damage function, with different symbols:
1.3.2 Model adjustments
At the core of the damage function in PAGE09 is the Equation (5).14
d = alpha * (TACT/TCAL) ^ beta
where d is the damage, alpha is the damage at the calibration temperature, TCAL is the calibration temperature rise, and TACT is the actual temperature rise, beta is the damage exponent.
The calibration temperature is on average 3°C. Therefore, if the actual temperature rise is 3 °C, on average, the damage equals alpha. The damage exponent, beta, becomes more important as temperatures rise above TCAL. In the standard model, beta is entered as triangle (1.5, 2, 3). Therefore, on average, the exponent is 2.167 (slightly above a quadratic), meaning that at twice the calibration temperature (on average, TACT equals 6°C), the damage will be 4.5 times alpha. SOURCE
The damage function graphs out as shown in Figure 2, for various values of the power coefficient POW (also called “beta”) and RTT(t, d, r) (also called “TACT”).” http://wattsupwiththat.com/2011/10/01/canadian-contretemps/#more-48527

If I could leave Ontario and go join, vote, and work for the Wild Rose party, I’d do it.
I can’t fathom what the Alberta “Conservatives” are thinking!
Lori, they’re thinking the same crap as they are in Ontario. Later this week we are going to watch the PCs snatch defeat from the jaws of victory.
They aren’t conservative. They’re tax-and-spend liberals who don’t get along with the Liberal Party.
I have a memory of being at the Meaford Tank Range as a young reservist many years ago. We were up there to fire M72 light anti tank rockets and the “Carl Gustav” heavy anti tank weapons. After spending hours doing our firing drills before getting access to the live ammo we all participated in a rousing chorus of “give peace a chance”. Soldiers have a rally twisted sense of humour.
It just might be that Alberta PC’s have just elected the best Premier Saskatchewan never had.

I received an interesting letter Thursday from Esther Enkins,CBC’s executive editor, and ethics expert. It is in regard to the ‘Vote Compass”.
Dear Mr.(wallyj):
Thank you for your e-mail of July 23 addressed to Kirk LaPointe, CBC Ombudsman. Since CBC News falls in my remit, I would like to reply.
You wrote in substance to ask why the “final results” of the Vote Compass survey have not been published, suggesting that the absence of such a report only “fuels the speculation” that the survey was biased.
Let me be clear that Vote Compass, as CBC repeatedly emphasized throughout the election, is not a survey. It did not provide voting advice. It was primarily an educational tool designed to engage Canadians and help them quickly find where they stand relative to the major parties in the election. It did not attempt to indicate whether someone supports a particular party. What it did do is graphically illustrate where an individual’s answers to particular questions fall in relation to a party’s policies, based on the parties’ answers to the same questions.
It was posted on the CBC News.ca web site and Canadians were invited to try it. For that reason – the sample was self-selecting – it could never meet the scientific methodological standards expected of random sample surveys.
Vote Compass is modeled on similar applications used during European election campaigns for more than a decade. Vote Compass was not designed by CBC. It was created by a team of academics from across the country – Vote Compass Canada. The data is and always has belonged to Vote Compass Canada, not the CBC. As part of our agreement, CBC had exclusive access to the academic team’s analysis of aggregate responses. We do not have, nor did we ask for, the kind of information you suggest we should publish.
Some months ago, CBC Ombudsman Kirk LaPointe was asked to review complaints that Vote Compass was biased. He concluded that it met CBC’s standards for fairness and accuracy. As he noted in his July 26 reply, you can find his review here:http://www.cbc.ca/ombudsman/pdf/2011-06-21-Burdett-Deimert.pdf.
Thank you for your e-mail. I hope my reply has reassured you of the continuing integrity of our news service.
It is also my responsibility to tell you that if you are not satisfied with this response, you may wish to submit the matter for review by the CBC Ombudsman. The Office of the Ombudsman, an independent and impartial body reporting directly to the President, is responsible for evaluating program compliance with the CBC’s journalistic policies. The Ombudsman may be reached by mail at Box 500, Terminal A, Toronto, Ontario M5W 1E6, or by fax at (416) 205-2825, or by e-mail at

Well,I have a few problems with her response, the least of which is that she refers me back to Lapointe if I’m not satisfied with her response. The circling of the wagons was to be expected.
I will be contacting Elections Canada in the next few days and would like some input from others that may see something that I have missed.
If you have the time, read the link in this letter, and get back to me. I have e-mailed the ” Vote Compass ” people, they have not responded. However,a couple of weeks ago,cbc had a live blog thing going on,and someone did ask for the results. They were told that the results were available at the ‘Vote Compass’ site, and had been up since May 3rd. That response is at best a misunderstanding, but quite likely an outright lie.
Thanks,wallyj.
Furthermore to clarify my above post. I e-mailed the vote compass people back in May,and again in June. They have not responded.

where d is the damage, alpha is the damage at the calibration temperature, TCAL is the calibration temperature rise, and TACT is the actual temperature rise, beta is the damage exponent.
SOURCE
The damage function graphs out as shown in Figure 2, for various values of the power coefficient POW (also called “beta”) and RTT(t, d, r) (also called “TACT”).”

Here’s more from the left when Rob Anders said “No” to Liberal Ad$Cam Chretien. It’s a hoot.

From September 4, 2008
With Nelson Mandela due to arrive in Canada in the fall of 2001, a motion was put before parliament on June 6, 2001, that would make him an honorary Canadian citizen. Foreign Affairs Minister, John McCallum, with the support of the four opposition foreign affairs critics, read the motion. So, when the speaker asked if everyone agreed that “Nelson Mandela, icon of the human spirit, be hereby declared to be an honorary citizen of Canada”, everyone agreed.
Except for a shout of “No” from MP Rob Anders.
Rob Anders later tried to defend himself by calling Mandela a “communist” and “a terrorist.”

And indeed…. here we go!
The PC/Liberal Party of Alberta lurched far left last night and installed Leftwinger Alison Redford as the latest disaster. With only about a 50% turnout of PC/Lib Party members. http://news.nationalpost.com/2011/10/02/alberta-pcs-pick-a-new-premier/
It just might be that Alberta PC’s have just elected the best Premier Saskatchewan never had.

“The cabinet was due to meet on Sunday evening to discuss a plan to begin layoffs by setting up a “labour reserve.” Under the plan, 30,000 workers would be put in the reserve by the end of this year and paid 60 percent of their salaries for a year, after which they would be dismissed.
The government has yet to announce how the programme would work, including details such as whether it would be used to push out younger workers or only to accelerate the retirement of workers already reaching pension age.”

The Ombudsman may be reached by mail at Box 500, Terminal A, Toronto, Ontario M5W 1E6, or by fax at (416) 205-2825, or by e-mail at
Sincerely,
Esther Enkin
