Trump’s lawsuits are good for American democracy

This past weekend I’ve asked two questions to my friends who are afflicted with Trump Derangement Syndrome:

  • You do realize that Biden has not yet become the President-elect, right?
  • In the Year 2000, Al Gore rightfully pursued his legal options and things weren’t decided until mid-December.  How come Donald Trump doesn’t have the same right to do so?

In many cases I received stunned silence to both of these questions.  In a few cases I was met with absolute hostility.  But the smarter ones answered ‘Yes’ to the first question and conceded the second.

Others are arguing the same point more vociferously:

For centuries, we have asked people who are unhappy with their fellow citizens or government agencies and institutions to bring their claims to court, where laws of evidence and ethical rules govern the proceedings. President Trump has not broken with these traditions; he has honored them. As long as his claims are not entirely frivolous from a factual or legal perspective, he may direct his lawyers to present and zealously advocate his claims in court.

So far, it seems the courts are doing their job. When the president went to federal court to claim that Pennsylvania should stop counting ballots as long as Republican observers were excluded, the judge asked the president’s lawyer “as a member of the bar of this court” whether any Republicans were present as ballots were counted. The lawyer responded, “There is a non-zero number of people in the room.” Lawyers, unlike politicians, are not allowed to lie, and so Trump’s lawyer was constrained, if only grudgingly, to acknowledge that Republicans had not been entirely excluded. The judge denied the petition but asked the parties to work out an agreement about how many people could observe the count and how close they ought to be.

    If you don’t allow the legal process to play out, then like the other side did after 2016, the doubters will claim the other side must have cheated.

    1. Yes. Trump has close to 70 million supporters. Many feel cheated. The court investigations are needed to clear the air.

    We will not participate in the leftist, Biden/Harris Green New Deal. We do not support the banning of fracking. The United States of America operates as a capitalistic economy and OIL is the fuel she survives on. With this being said, we will STOP ALL TIRES for 24 hours on Veterans Day 11/11/20. If this is not effective and our leaders do not respect that blue-collar truck drivers are having to face domestic terrorism, primarily in democrat run cities all over the United States, and that we do not support the banning of fracking in any way, then we will have our second STOP OF TIRES for FOUR full days 11/26/20-11/29/20.

  3. If dems can spend two years looking into election fraud al la Muller, they can wait a couple months while Republicans do the same.

    Personally, I am coming to terms with a Biden presidency. The establishment threw everything humanly possible at the good Trump… and barely squeaked out a victory (tbd).

  4. You are missing the point.
    The problem with Trump is he is:

    1) making claims of massive fraud with zero evidence. he is deliberately undermining faith in the electoral system simply because his ego is too big to accept he lost; This is bad for the country and pisses a lot of people off – especially republican officials in states that are being accused of being corrupt and/or incompetent.

    2) historically, recounts have never overcome deficits of 10K+ votes in multiple states. With Gore Vs Bush the difference was less than 1000 votes in one state so it was litigated by both sides because it could go either way. So Trump’s legal efforts are being made in bad faith with no reasonable prospect of success which means Trump sows division for a few weeks when the country should be planning a transition.

    The latter point is why civilized candidates for president concede once the *unofficial* results make it clear that they have lost even if it is “not official” and there are legal avenues open to them.

    IOW: your arguments are complete red herrings because they don’t matter to most people and they should not matter. Just because Trump can do something does not mean he should. Most politicians can look beyond their personal benefit and think about what is good for the country. But that is not Trump – everything has to be about him.

    BTW: I would be making the exact same argument if Trump had won by the same margins and Biden was talking about litigating. Clinton’s advice to refuse to concede was inappropriate and it probably stems from her bitterness over losing 4 years ago.

    1. I don’t think you know what evidence Trump has. Refusing to investigate when 70 million feel the election was stolen is worse for the country, and that is what destroys faith in then process. Historical examples are not relevant as cheating has not previously happened on such a massive scale. If Dems did not cheat, the Biden victory will be confirmed. Court investigations are the only way forward. The are the safeguard that retores faith in the electoral system.

  5. The president of Mexico won’t comment on the election or talk to Biden until legal issues are resolved. But Great Leader Kim Sung Trudeau talked to China Joe today according to his bought and paid for media. They talked about global warming and racism against blacks.

  6. BTW: the fact that Trump lost but the dems were humiliated in the house, senate and state elections is pretty strong evidence that the vote was fair. If the fix was in don’t you think they would have done a better job of ensuring a democratic senator got in in Georgia?

    1. Biden’s margin consisted of ballots with no down ballot votes. Thus the humiliation of the dems is not evidence of a fair vote. It’s evidence they just didn’t have time to make that many marks.

      1. Sure. 9/11 truthers have an answer for everything. Fire can’t melt steel so it must be a planned demolition. Sparks are irrefutable evidence of ingredient used in building demolitions. Trump lost so it must have been fraud. Same arguments over and over.

    3. No. That is exactly what makes the Biden win do suspicious. They have to ensure that the paper ballots match the electronic count. They simply did not have enough time to tamper with voting further down the ballot.
      It is foolish to speculate at this point. The courts will decide if cheating has occurred. You just need to hope that your guy did not cheat. Good luck with that!

      There is so much fraud, legislatures will abstain from selecting Electors.

      No one will reach 270.

      Then Congress is the end game, where, GOP has the lead, 26-23. THEY select POTUS.
