On Thursday the Supreme Court of Canada struck down a piece of Quebec legislation, Bill 104, that banned certain methods non-francophone parents had used to enable their children to attend English-language schools in that province. Under Bill 101, the French Language Charter, only those parents who were educated in English themselves and those with a child who had a year of education in English (which could be outside Quebec) could obtain English-language education in the public system. Some grade-one-only unsubsidized private schools sprung up within the province to enable parents to get around Bill 101. Thursday’s judgment merely said that a blanket prohibition was not justifed, and that each child’s case should be judged individually on its own merits.
The real problem of course is Bill 101 itself, which violates the rights of non-francophones. The heart of the matter is the spurious notion of “protecting the French language”, which is an anti-concept. The purpose of government is to protect individual rights that humans possess, which includes the right to live one’s life using the language(s) of one’s choice. Languages do not possess rights. Failing to understand this is the mistake that has caused so much grief.
In the Gosselin case (2005), some francophone parents who wanted to send their children to English-language public schools were turned down by the Supreme Court. This discriminatory ruling meant they have fewer rights than anglophone parents.
Quebec is entitled to name an official language, and since French is that of the vast majority, it would be foolish to pick any other. But maintaining the dominant status of French must depend on the individual decisions of the province’s inhabitants to continue speaking it. 500 years ago there was little or no French in Quebec. 500 years from now, there may not be either. Or possibly the entire North American continent will be speaking French by then. Either way, it’s no concern of ours today — it will be up to our distant descendants to choose, not us.
I repeat: languages do not have rights, and therefore cannot be “protected” by government. Only the individual’s right to speak in the language of his choice should be protected.
Also on Thursday: the B. C. government will stop the prosecution of the polygamists in Bountiful and will seek a reference at the Supreme Court of that province as to whether the federal legislation prohibiting polygamy is unconstitutional under the Charter of Rights. (Why it goes to the B. C. Supreme Court instead of the Supreme Court of Canada is unclear to me)
Governments cannot stop people from making any kind of living arrangements with any number of people of the opposite and/or same sex that they wish. The real issue is things like tax deductions for one’s spouse, joint pensions, and the like. When the gay marriage issue was up in the air, its proponents denied that it would be a “slippery slope” that would ultimately lead to polygamy. Only a few years later, that has seemingly been proven false. Since gay partnerships are pretty much analogous to straight ones except that no offspring can result from their conjugal activities, there’s no reason to prevent them from having a spousal tax break, and so on. But there’s also no reason to allow anyone to claim for more than one.

Speaking of Lizzies proposed $50.00 tonne carbon tax,i noticed that on the CCX (Chicago Climate Exchange) Carbon Financial Instruments are now trading at .10 cents per tonne! Just think in May of 2008 they were trading over $7.00 per tonne! I wonder if the uncovering of the hockey stick scam has anything to do with this wipe out? People that thought they were going to get rich trading carbon credits are now losing their ass…i love it!
