The big issue with these overseas accounts is whether or not the presence of such overseas investments has been properly reported to CRA. For an individual, it’s the T1135 which has to be filed yearly with the T1 if a taxpayer has overseas investments/property which AT ANY TIME IN THE YEAR have a cost of more than $100,000 (I am simplifying). Am not conversant with all the nuances of the T2 (corporate tax return) but am fairly confident there is a similar provision. As well, CRA can look at a given transaction or series of transactions to see if it breaks GAAR General Anti-Avoidance Rule). That’s a vague rule, but has been used when it is felt that the transactions are solely for a tax benefit and are abusive in nature.
The big issue is whether or not CRA has the willingness or the expertise to go after the big boys – the really selfish ones who enjoy lifestyles beyond the wildest dreams of the most successful doctor, lawyer, or small businessman. Or would they rather try sticking it to those who haven’t the means to hire the fancy tax lawyers and accountants.
