    I believe in pure Free Speech. If you want to be an idiot and burn the flag….more power to you. Of course, doing so in a location that restricts open fires for safety reasons (like the middle of a street) is a violation of already current laws.

    If you want to burn a flag in your front yard. That’s fine with me from a legal perspective. And, I’m not just talking the burning of an American flag. Any flag inclusive of the rainbow flag. Which makes me wonder if this is a back door effort to stop municipalities from prosecuting people who peal out on a Pride mural painted illegally in the middle of an intersection, or burn a Pride flag as a form of freedom of expression.

    Adults don’t burn flags. Immature, self-centered attention whores do. But, people are allowed to be immature, self-centered attention whores in a free society.

    1. For the most part, I agree: this does seem draconian. But until today, I never really looked at the Johnson decision.

      The highlighted part is key. There is still a burden of proof, but if flags are considered vessels of free speech, then they can also be considered vessels under the “yelling fire in a movie theatre” test. Incitement to violent, lawless action is actually a crime. Until now (AFAIK), no one has attempted to take a flag-burner to court for such incitement. I guess we’ll see if the sea-lawyering holds up.

      1. Not a big fan of “pre-determination.” If someone riots because some other idiot burned a flag…that’s on the guy that riots. We all make our own decisions. Some are good. Some are bad. Some are irrelevant. People are influenced by different things.

        Yelling “fire” in a crowded movie theater is an apples and oranges rationalization. There is a semblance of trust involved that assumes that the individual yelling “Fire” is warning of immediate danger that discounts your ability to determine facts necessary to form an opinion. Not so with burning a flag.

        Additionally, someone burning a flag is expressing their own opinion. They are not specifically expressing yours, because only YOU know what that opinion is in full. The last thing we need is laws that actually cater to the “lemming” qualities of mindless, gullible, and malleable idiots. That sort of philosophy will quickly seep into the legal system as a whole.

        Something as simple as someone telling you they are being bullied at school, and you say, “I’d put an end to that quickly if I were you.” Then, the bullied person does something illegal and irrational. Did you incite that act?

        The wording is clear, prosecution for those who break existing laws, while burning a flag or not.

        The Left is against that.

  5. If I burn the Pfffagggg flag in the middle of a city street, I’d be arrested for a HATE crime, and for inciting violence. If I burn an American flag and a papier-mâché Trump head in the middle of a city street … I’d be cheered by the public and my local police officers would kneel because they saw an American flag.

    Yes, there’s something very unconstitutional about those scenarios.

    However, how many protesters will run right out to burn a flag? And, if you are free to burn one flag, then you should be free to burn any flag.
    And of course what Thucydides said about the Dems now spending money on this, as well as political leverage.
