  2. The fact that so many cases like this end in acquittal when everyone was sure there would be a conviction says much more about media bias than any problem with our justice system.

  3. The process is the punishment and as Phantom writes – what’s the point of being acquitted by a jury of your peers only to see it appealed by the Crown.
    What a joke.
    The gov’t doesn’t necessarily want to see you in prison, it’d be nice but financial ruin will do just fine.
    And if they see you warming up a can of beans over a fire under a bridge, all the better for them.

  4. There is no backing away from this crap, it’s bound to get worse. Recall the fellow in Sask defending his stuff on his farm? As far as I know he is still involved in the courts – it takes years!
    The institutions are far too entrenched. The only solution is to start over. I’ve battled with a friend for years over whether to get rid of the senate or the ‘supremes.” I say keep the senate but dump the egotistical Supreme court! Won’t happen until there is a vote to get the Hell out of Canada.
    With Wexit, there can be a new beginning and many new opportunities to finally get things right.

    1. I was thinking about the Saskatchewan guy too. Known criminal in a car with some of his buddies, having just robbed two previous farms, pulls into his farm and they leap out in plain sight and try to start his quad and rifle through the trucks and shop looking for stuff to steal. The driver tries to take off. The farmer, terrified his wife has just been run down races over to shut off the engine and in the process his gun fires and the thug is shot and dies. Suddenly the press is full of takes about what a great person the indigenous guy is. Not one word about what they were doing to end up on the farmer’s property or what they done before. The press report some racist White guy shot a perfectly innocent angel child of the Holy Indigenous people who came to the farm looking for help with a flat tire. The province of Saskatchewan refused to appeal his not guilty verdict. Who in Ontario is going after this guy?

    2. I think you are referring to Gerald Stanley’s case. He was acquitted in FEB 2018, (a jury trial) and the prosecution did not appeal, so I wouldn’t say it’s still going on in the courts.

      But the court case isn’t all that isn’t still going on: of course they felt they had to sell the farm and moved away from the area to avoid tempting certain local elements to seek alternative “justice.” You could say he lost his home and way of life for trying to protect it.

      1. Mr Stanley was convicted of improper storage of a firearm. This didn’t satisfy PM Zoolander, so Jury Peremptory Challenge was removed in Oct of last year. You will get the jury the government is satisfied with, properly diverse.
        Next will be ensuring the convictions or acquittals the Government wants.

  5. The recent incident where the courts released a man 4 times for disobeying his girlfriend’s court order to stay away from her is truly sickening. The fifth time he got out, had a gun and shot her to death. The gun was an illegal one and he had been jailed for having this weapon.

    We truly as citizens have zero rights. I makes me ill to read how the RCMP was totally to blame for the murder of 22 people in Nova Scotia. As Paul Palango writes the female officer executed by Wortman should never have been on her own while this murderer was on the loose.

    As I have written before when a ETF officer says to me we have been told to stand down and accept collateral damage as the Black Bloc smashed downtown Toronto we are done as nation.

    2. Just like bar owners are held partly responsible financially for impaired driving crimes, Judges should be held partly responsible for the outcomes of their decisions, especially given the wide disposition parameters available to them in each criminal case.

        And they shouldn’t be. The law that allows for it is insane, wrong and unjust. Nor should drunk drivers be held accountable for injuries sustained by the very people they were drinking with and then got into a car together with.

      2. That is because a shyster decided to go with the one at fault based on the person with the most money. That is the bar owner and not the actual perpetrators.
        If you’re wealthy and witness an accident you may want to get the hell away. It’s only a matter of time before a shyster says the wealthy witness is to blame.

It “was” self defense your honor, He was in the house, don’t bother with those drag marks from the garage to the side door, and no, I don’t know why only my prints were on the carving knife and not his, but it was from my kitchen, so of course they were my prints on it. The reason I took a short while to call the cops after the event, was because I was so distraught, not because I was ahem, arranging the scene or something.

    This crap annoys the hell out of me. Once the thugs realize, and a lot of them already do, that if we defend ourselves, we will be the ones punished, and they think they will have free reign to abuse the citizens. If I must defend myself I will, and I’ll worry about the consequences if I can’t hide the body, and do get caught!

    The prisons are not delightful places, but it’s at least free room and board if I’m sent to one. I’m to old to be a problem for the interned thugs, and they will probably leave me alone, but if not, all I can say is, revenge is a dessert best served cold. So I would bide my time and get em later, they can’t lock me up for murder again, if I’m already locked up for murder.

Alan Rock said, “Canadians do not have the right to defend their lives with guns” when he was Justice Minister and wanted to confiscate all guns but settled for the “Registry”. The Police brass are politicized drones and too many Judges are SJWs.

  15. The process is corrupting trial by jury, (they like they can do that at will), but the conclusion is a common rule of self defence in the rest of the English speaking world.
    I see no details there, but shooting in self defence can happen when you or someone you or someone else is in reasonable fear of of death or serious injury. Shooting in defence of property alone has never been a reason.

    The Australian State of NSW has excellent “castle” laws, ie. break into my house armed I can shoot you dead and that’s all she wrote. Texas you can shoot in defence of property alone. In the UK no-one beyond the criminals and the gamekeeper are armed with firearms, that solves most self defence problems, (it’s a grubby little Statist hole these days).

  18. This is state of affairs is easily rectifiable. Have the Criminal Code amended to get rid of the ability of the Crown to appeal from a jury trial and have Canada rejoin ever other common law jurisdiction with a the rule that acquittal by a jury of one’s peers marks the end of a case.

  19. I’d like to see this law in which the Ontario court of appeals has the authority to overturn a verdict by jury.
    And if so what was the reason as to why it was overturned.
    It should also be noted that the thief being a native American Indian shouldn’t be relevant.

    1. The nullifying of a Jury Verdict is not trivial… (Has been done in exceptional situations).. The Judges would normally have a huge burden proving validity… Not so much in Canada as SCOC is bound by International Law

  20. Simple solution. You know who your friends are. You know who can be trusted to help you and remain quiet.

    Pick out a location, remote. Have the hole pre-dug, ready for when you need it. Stock up on ammunition, then report all your guns “stolen”. Hide them somewhere where you can access them but the feds will never find them.

    In the case of a home invasion, don’t call the police, call your fiends. And then have a nice drive out to your previously prepared location. Shovel. Shut up. Start preparing a second site in case another unfortunate event happens.

    This is what anarchy looks like. Nasty, brutish, and short.

    Insurance only replaces the bare bones loss. In 99% of the cases, it cannot replace what was lost. Your car may be 10 years old. It is gone and now you have to replace it with one that is just as reliable; another 10 year old car that the insurance company finds will likely be junk. Even when a judge orders a thief to pay for what he stole it is based on the lowest deprecated value and even then you’ll never collect.

    Liberals love to smugly tell you that’s why you have insurance. Thus, they can go to their life insurance policy and replace their murdered loved one. F’n a$$holes.

It’s sad to read all these comments and know that it will only get worse which is why I moved to NE Florida and live in an area where Trump signs proliferate as the occasional “This community is armed” as well. We live on 7 acres outside of a small town and unlike urban centers they know that we are prepared. There is no way I would ever go back to Canada, it’s become a sad state.
