Responding to a motion by my co-defendants the Competitive Enterprise Institute and Rand Simberg, the Court has now ordered Mann to cough up his income records from 2007 along with any evidence of reputational damage. If m’learned friends will forgive a zippy generalization, when you sue for defamation, there are various kinds of damages: “Defamation per se” commands damages in and of itself without evidence of actual losses; on the other hand, compensatory damages requires evidence that you lost 27 grand here and 49 bucks there. Mann had argued that, as he was claiming defamation per se, he didn’t need to show evidence of monetary loss. Judge Anderson has now reminded him that that’s not what his statement of claim actually says…

This should be another Mannian crash-and-burn. His suit against Tim Ball collapsed when he failed to disclose and the court threw out his case with costs awarded to Dr. Ball.

A lot of these leftist scientist agitators are thin-skinned evasive twits. Similar things happened in the suit by Stanford’s Mark Jacobson against a group who reviewed his paper about renewables could power the world. Jacobson got nasty and sued when they bounced his paper like a rubber ball. And like a coward Jacobson did it against the one reviewer that had no institution to defend him against possible liability. The difference is that Jacobson withdrew his suit after attracting a ****storm of criticism in which “coward” was probably the lightest epithet thrown at him. Mann is by most reckonings has a thicker skin, but such won’t save him from an honest judge.

Wonder if his income statements will include any honoraria he received for speaking in front of renewable energy groups. After the hatchet job his henchmen attempted on Willie Soon, if he did receive any honoraria, I sure hope he disclosed them in all his papers.

I so hope Mann is forced to pay up.

He likely instructed his shyster to stall with whatever sleazy angle he can come up with as Mann won’t actually stoop to providing his income statements. He’s a self-proclaimed Nobel prize winner you know. The little people shouldn’t be allowed to criticize his work.

Whatever happened to “Justice Delayed is Justice Denied?”

It sure seems like Mark Steyn is more interested in resolving this lawsuit than Michael Mann, his lawyers, or the court system itself. Has Michael Mann payed out for any of Tim Ball’s Court Costs yet?

By 2003 the gang are on top of the world. Michael Mann’s famous ‘hockey-stick’ temperature reconstruction has appeared to be the irrefutable Sign, Oh Lord, of mankind’s guilt which they have hoped to find with such Biblical fervour.

Predictions of effects of warming have become increasingly hysterical. Governments are alarmed and the grants are bountiful.

Privately they will still admit to problems, uncertainties, how much they don’t know; they will even gently or not so gently query the reliability or value of each other’s work, sometimes appear to have difficulties reproducing it for themselves; and sometimes say bluntly it is worthless. But they adopt a stern policy of pas devant les domestiques and to the media present a united front of complete confidence and mutual esteem.

They are still curious and inquiring, try to resolve the problems; but it genuinely never seems to occur to them that the answers may lie outside the theory of man-made greenhouse warming, or that they may not be problems at all without it. Every apparent contradiction must be fitted into that paradigm with crowbar or blowtorch.

More, it never occurs to them that anyone else could question the theory in good faith. Any scientist who raises doubts is automatically dismissed, and slandered, as having been paid to do so by big oil.

Or the article quoted at the bottom of 0965750123, for an indication of how many years ago (1997) the oil companies started to jump on board the AGW bandwagon.

Back before the Web was controlled by the Communists…. I read Mann’s response to Penn State & their inquiry into his Science, but alas can’t find it anymore… To lazy to spend time hunting……It’s hidden somewhere most likely @ Penn State….

Mark Steyn is a great man and a great benefactor to science.

Those of us who knew his work – his intelligence, his pugnacity – thought that Mann was foolish to attack him. And so it has proved. Steyn’s assemblage of scientific views on Mann’s work is utterly destructive of his reputation.
