ProTip: Next time the RCMP come calling with questions, cite ‘cabinet confidentiality’.

The RCMP has been looking into potential obstruction of justice in the handling of the prosecution of SNC-Lavalin Group Inc., but its examination has been stymied by the federal government’s refusal to lift cabinet confidentiality for all witnesses, The Globe and Mail has learned.
 
This means individuals involved in the matter cannot discuss events or share documents with police that have not been exempted from the rule of cabinet confidentiality, according to sources, who The Globe agreed not to identify so they could discuss the RCMP inquiries.
 
In Canada, the principle of cabinet confidentiality is intended to allow ministers to debate decisions freely in private. As a result, discussions involving cabinet matters must be kept secret unless a waiver is granted. In the SNC matter, the Liberals say that the Clerk of the Privy Council, who heads the bureaucratic agency that serves the Prime Minister’s Office, made the decision not to offer a broad waiver to either the RCMP or to the Ethics Commissioner, and that the PMO played no role.
 
A source who was recently interviewed by the RCMP told The Globe that investigators indicated they are looking into possible obstruction of justice. The Criminal Code says obstruction of justice occurs when an effort is made to “obstruct, pervert or defeat the course of justice in a judicial proceeding.”
 
The national police force will pause the operation because of the coming election campaign. Prime Minister Justin Trudeau is scheduled to go to Rideau Hall Wednesday to ask the Governor-General to dissolve Parliament and call the vote for Oct. 21, and the RCMP has a policy to suspend politically sensitive operations during campaigns.

    Really? I have a passing familiarity with the Criminal Code of Canada and I cannot remember the bit where it states, “During election campaigns, criminal investigations into the conduct of sitting politicians shall be suspended.”

    Nor, frankly, is Cabinet Confidentiality in Criminal Matters a thing.

    This is where the Conservatives can run up big points. Why is the investigation suspended? Why can’t the RCMP pierce Cabinet Confidentiality to get their man? And, hey, while Trudeau is the ultimate target, when did the gunsels like Butts and Telford get Cabinet Confidentiality immunity? They are not in Cabinet.

  8. Good article by the two Globe and Mail writers, Daniel LeBlanc and Robert Fife. Mr. LeBlanc was the lead investigative reporter, way back when during the AdScam scandal, and Robert Fife is the current lead reporter in the current obstruction-of-justice scandal. True, the Globe is leftist and pro-Liberal, but at least these two reporters cannot be bought off. We can hope the dominant media cartel will republish the findings of this article, to kick off this election.

  9. If the average person can’t legally hide something from a police investigation, then neither should any politician, sitting or not. If an investigation into my behaviour doesn’t stop during an election campaign, neither should that into political operatives, sitting in government or not.

    Canadians are equal before the law, or they are not. Corruption is much too mild a word.

    Related, I continue to be amazed by how many judges seem to be unable to read and understand the laws upon which they are expected to issue rulings. Supposedly, a Scottish court ruled that it’s unlawful for a PM to prorogue Parliament. Who knew?

    Not sure who “They” refers to. As for timing, after obstructing the SNC-Lavalin Group investigation, the timing is the government’s.

  11. Funny thing is, the Criminal Code only recognizes two kinds of immunity/privilege: client to lawyer communications, and communications between spouses….and even then only under certain circumstances.

    So, lay the f*&^%$g charges, subpoena all the bastards, and lets see how our bought-and-paid-for press performs.
