Unfortunate move by the Doug Ford government. This is how Conservatives lose governments.

Ontario will appeal court’s OSPCA act decision; It leaves a bad taste with those who fought the five-year battle

The Ontario government is appealing a recent court ruling that the OSPCA Act violates the Charter and needs to be rewritten.

A January 25 email sent by lawyer Kurtis Andrews stated, “I have received informal notice that the AG (Attorney General) will appeal the OSPCA Act decision. Counsel for the AG confirmed it with me by email.”

On the same morning, Tom Black, former long-time president of the Ontario Landowners, who had fundraised six-figure money to fight this five-year court challenge, was bitter.

“We have no more money to keep on fighting this,” said Black. “Government and the agriculture organizations know that, and are, apparently, happy this morning.”

Black felt betrayed by those politicians pretending to be in favour of overturning the Act when in opposition, but now being part of a government, which wants to appeal, in court, any attempt to change the OSPCA Act for the better.

Conservative MPPs like Toby Barrett, Jim McDonell, Steve Clark and John Yakubuski – with the latter two now in cabinet – had been to some of the Animal Care Review Board and court hearings, recalled Black.

Earlier in January a Conservative MPP, who wished to remain unidentified, notified Ontario Farmer that, “Ernie (Hardeman) and OMAFRA want nothing to do with this,” (handling livestock humane cases in the future) Budgets were being frozen across the board, and OMA-FRA, centered in Guelph, had lobbied Hardeman hard in early January they didn’t want their salaries and positions diminished by on-farm staff being hired out in the countryside to do inspections, said the MPP.

Black believed there was enough of a groundswell for support for OSPCA reform among the Conservative rural caucus that their arguments and force would have carried the day.

“This court ruling was a gift handed them, if they were even remotely serious about reform,” he said.

The harsh things that happened to people in rural Ontario under the OSPCA since 2008 would not have been on the Ontario Attorney General’s radar, “who came from a different world than the rest of us,” quipped Black.

Would the AG, “have heard from farming and livestock groups in January?” asked Black. “You know she heard from the animal rights groups.”

There was a January 24 TV program in Toronto that had four representatives to speak about this Act being defeated, and agriculture sent no one to deliver their perspective, said Black. On that program, the night before Andrew’s email, Toronto lawyer Brian Schiller from Clayton Ruby’s office stated that the government was going to appeal.

“I was just sick,” said Black. Farmers will know soon enough whether Ontario agriculture organizations had just sat on their hands in January, and now regret not lobbying the government, said Black.

Or else these agriculture organizations were a main part of the effort to tell the government to appeal this ruling, since their financial ties, such as being paid to train OSPCA inspectors, was more important, said Black.

“If agriculture groups put up the big money to fight this appeal against the government, because the Landowners aren’t, we can’t anymore, that will say a lot,” said Black.

“But if they don’t put up the money, then we know for certain they are Judas, like we have suspected all along. Just like those rural MPP’s.”

  1. Just like Harper as soon as the Conservatives get power they try to out Liberal the Liberals. Just like Harper no backbone. All of Canada’s political parties are varying shades of Communist

  2. As I said when Ford was elected. I life Ford but I don’t like or trust the rest of the red tory b*stards

    1. So it seems. At least very few of them and when they get to Ottawa or Queen’s Park they get told where it is at.

      1. I always remember Preston Manning saying that most well intentioned politicians go to Ottawa and get Ottawashed.

I guess this is being Torontowashed.

Too bad. I had expected more.

  3. Haven’t been to impressed with Ford at all really, they seem to be fumbling around at trying to govern.
Ya we are broke but should it be really that hard to help people be more free and prosperous?
I’ll be sending a message as well.

  4. And as such….a little notice to Mr Jason Kenney.

Don’t even think, about keeping the Carbon Tax “only” on Large Emitters. You know as well as I do, that any CO2 Tax on said Large emitters will be handed right back to the consumer.

Do it..? & you may well have a Revolution on your hands…

  5. Ford and Co. have made their decision because they know that Ontario’s farm organizations have abandoned their membership on this issue and others. There has been no opposition from the OFA, NFU, and CFFO to the many excesses of the OSPCA, and the Government knows damned well the silence from those organizations and the press will continue.

However, the vast majority of farmers have tolerated the cuddly relationship between their organizations and the Government for the last two decades, so they deserve the continued oppression their silence has sown. I feel so sorry for those who have suffered because their neighbours were too cowardly to help them.

    1. Bingo Jamie. This terrible situation has its roots in the “Farm Registration and Farm Organizations Funding Act, 1993” (I could go all the way back to supply management…) when the “accredited” farm organizations sold their souls to the devil. Farmers are legally compelled to pay/join one of these three groups in order to receive tax brakes and subsidies. The government has been able to establish thousands of confiscatory statutory regulations negatively affecting rural people and their properties without a peep from farm organizations because they are compromised. The omnipresent fart-sniffing “farm representative” lackeys scuttle about Queen’s Park believing themselves to be important, while giving away farm assets and rural liberties with both hands.
They’ll never stand in opposition to OSPCA-types because of the optics. Neither will lily-livered Red Tory politicians.
Ford looked at Ontario’s farmers and read the tea leaves with cold, calculated prescience.

  6. The only difference between a NDP govt a Liberal govt and a Conservative govt is that the NDP admits they’re socialist.

  7. And yet, despite the failure to actually do anything, everyone will just keep voting for their team.

The cost of betrayal has officially been set at zero. The partisans will never withdraw their support. You have exactly the politicians you deserve.

Harper did not kill the CBC, and you kept voting for him. Infanticide is untouchable by all politicians, yet you keep voting for them.

Does your support come with any price tag? Cause you are getting exactly what you are demanding.

What’s that? You never made any demands? You just kept renewing your membership and sending donations, and volunteering? Oh…

    1. “you never made any demands”. Yes I made demands but they were killed at the local riding AGM meeting. The lowly voter can only look at the field of candidates and choose which corrupt and evil party they would like to steal from them. A moral and ethical political party does not exist because they have no chance of winning. Read the paper ‘The Case for Evil’ http://captaincapitalism.blogspot.com/2017/05/the-case-for-evil.html . The majority of Canadians have been convinced that evil is actually good and is an outward expression of their own twisted beliefs.

      1. “The lowly voter can only look at the field of candidates…”

No, there are other avenues besides an X on a ballot, Lone Ranger. It’s just that no one is ready (yet) to take them.

  8. Is this entirely on Doug Ford’s shoulders, or is this the Deep State doing what it does, regardless of who is in power?
    Who initiated the appeal?
Was it Deep State members (swivel servants) making sure that the current gov’t looks bad to their base?

  9. “Who initiated the appeal?”

Ford. And only Ford. His hand-picked AG, Caroline Mulroney, was just the messenger.

Kevin at 11:52 – dead on.

  10. Some commenters here seem to be possessed by the fantasy that REAL conservatives can think no evil or do no evil. Conservatives are just humans the same as liberals or socialists, susceptible to any sin in the book.

No conservatives in Canada? So where ARE these “true conservatives”,who live a life of absolute perfection, contemplating or committing no sins? I’d suggest a monastery in Tibet.

And we certainly wouldn’t want monks running our complicated world now, would we.

    1. “Conservatives are just humans the same as liberals or socialists, ”

      “just politicians”?

    2. Where are the real Conservatives? If you don’t know, then you, my friend, are definitely not one of them. I know because, I’m one, and you’re never at the meetings.

      1. IJ, I’ve certainly never seen YOU at any of the meetings either. You sound just like the socialists, “if you have to ask,you aren’t one of us”.

So, you go ahead and tell me who the Real Conservatives are, as you claim to be an expert on con-spotting. And tell me exactly WHAT makes a person a true conservative, his ability to fool some of the people some of the time?

Every example I’ve been given has turned out like Brian Mulroney, who was formerly a “true Conservative” until he proved he wasn’t.
I don’t wear ties of any color, am like Diogenes seeking an honest man, and have yet to find one wearing any party’s colors.

        1. “I don’t wear ties of any color, am like Diogenes seeking an honest man, and have yet to find one wearing any party’s colors.”

Sad but true, DM! It seems that power and perks eventually get to those who started out with the best of intentions..

  11. shucksamighty, when ITS THE ONLY GAME IN TOWN, ummm, what do we the little people do?
hmmmm? what fer gawds sake do we DO ??????

pollllllllllitishunnnnnnns are ALL the same underneath the labels and speeches and declarations and policies m’kay? “they ALL do it”. got it yet dear SDA? they are ALL the same underneath. it just takes an election win for ‘it’ to bubble up to the surface.

rinse and repeat. thus my voting strategy which consists in large part of voting OUT the present regime. keep voting OUT the current gubbamint *regardless* of what ‘party’ or ‘ideology’ they espouse.
that way the rot doesn’t go toooooo deep.

  12. Maybe the only responsible reaction to systemic kleptocracy is scorched earth.
    Vote the elected ones out.
    Fire all the career ones.
    Shred every “helpful” bureaucracy.
Legislate,by referendum, term limits and time limits on all who feed at the trough.
    And so forth.So much work.
So much easier to let it crash and burn, then plan to rebuild.
Except that way we lose most of the wealth we have accumulated.
Government is force, the power to steal and kill.
So join the biggest streetgang in the country..The Uni-Party wants you.

    1. really?
ummm, and WHO is it that ‘legislates’, sets, ahem, TERM limits for oh, sentors aaan’ judgey judges?
      hmmmm?

who in canadistans has the BALLS and BRAINS to do all this and NOT get sucked in by all the perks???
      hmmmm?

  13. The cost of putting your faith in a man-king…all the curses are listed in Deut. 28 As well as the blessings for doing it the right way.

Jer 17:5  Thus saith the LORD; Cursed be the man that trusteth in man, and maketh flesh his arm, and whose heart departeth from the LORD.

    trust = H982
    בָּטַח
    bâṭach
    baw-takh’
A primitive root; properly to hie for refuge (but not so precipitately as H2620); figuratively to trust, be confident or sure: – be bold (confident, secure, sure), careless (one, woman), put confidence, (make to) hope, (put, make to) trust.

    cursed = H779
    אָרַר
    ‘ârar
    aw-rar’
A primitive root; to execrate: –  X bitterly curse.

  14. There is a terribly sad lesson to all of this. It demonstrates beyond a shadow of a doubt that no matter what government, a very, very small group of fanatics – PETA, Greenpeace, Sierra, CPAWs, etc – runs this Country. And adding insult to mortal injury is the fact that uncountable millions of our tax-dollars are funding them. We buy the rope with which they are strangling us.

  15. PETA idiots have compared feeding your child meat as Child Abuse and then they go to schools and try to lure the kids with their crappy newsletter to kids THE ANIMALS VOICE its Child Abuse PETA practices with its YOUR MOMMY KILLS ANIMALS and YOUR DADDY KILLS ANIMALS as w ell as LIFE OF A COW propeganda PETA needs to be put down its like Rabid Wolf and as we might have seen in OLD YELLER what happens when animals get rabid
