In a major legal and political defeat for big labor, the Supreme Court ruled 5-4 Wednesday that state government workers – whether they join the union or not – cannot be forced to pay so-called “fair share” fees to support collective bargaining and other union activities.

 

The conservative majority said a union’s contract negotiations over pay and benefits were inextricably linked with its broader political activities, and concluded workers had a limited constitutional right not to underwrite such “speech.”

 

“This procedure violates the First Amendment and cannot continue,” Justice Samuel Alito wrote in the majority opinion. “Neither an agency fee nor any other payment to the union may be deducted from a nonmember’s wages, nor may any other attempt be made to collect such a payment, unless the employee affirmatively consents to pay.”

 

While the current case applies only to public sector employees, the political and financial stakes are potentially huge for the broader American labor union movement, which had been sounding the alarm about the legal fight.

  3. Listened to about 50% of Sean Hannity’s show yesterday afternoon. He hates me. I can’t think of another reason for him playing the recording of Maxine Waters losing her mind. Later on, Levin refers to people going “full Maxine Waters” to indicate complete lunacy.

    They’re really desperate. You hear desperation in their voices as they see control slipping further away, they’re looking around “their room” to see who will step forward as their great Democrat hope to save the day, and there’s not any success stories that can take any Red States.

    Yesterday Real Clear Politics had an article about the replacements of Kennedy and Ruth Ginsburg, so a gain of at least 1.5 for the right on the big bench.

  4. The (much) larger question is whether public sector unions are unconstitutional. As it stands, those unions and liberal politicians have an incestuous relationship. The politicians pass laws (or simply issue edicts) favorable to members of the union, who are employees of the government, as a quid pro quo for the humongous campaign contributions by the unions.

      You elect people; they represent everyone.

      Public sector union, therefore, NEGOTIATES AGAINST EVERYONE.

      But what if you elect the union (ie the ndp)? Tyen you just have lobbyists running the show.

      Well, I don’t see government unions as “unconstitutional” but public sector unions are certainly against the public interest. I’ve been saying this for the last 40 years, so you can imagine my delight with this ruling. As government has expanded, so has the power of these government employee unions. And it’s not just campaign contributions, it’s also gov employee voters voting there own interest and obstructing the efficient operations of government. “Incestuous” isn’t nearly obscene enough to describe the situation.

      The suit was originally brought in Illinois, a state known for catering to government unions but look for major fallout in California and New York as well.

      It’s been a good day.

    1. Praise be. Now pray God Ruth Bader return to her father in hell before the midterms, and gives the Supreme Court a 6-3 majority in favour of interpreting law, not making it up.

      (One day we’ll find out who killed Antonin Scalia.)

  6. This is huge. I suspect a majority of union members will quit now if they aren’t forced to be members, and those who do remain will expect value for money or they will quit as well. This is a huge step in ending the union/Democrat cycle of corruption.

    1. Probably. That’s what happened after Scott Walker did something similar in the state of Wisconsin. A big improvement in state federal and local finances might result because now the unions won’t be able to single-handedly hire the people who will be opposite them negotiating for pay benefits etc.

      And it was very popular with the voters, Even in many union households that were in the private sector

      When the history of the union movement is written, it will draw this lesson: the improvement of the lot of the north American working class in the 20th century was made possible by increased productivity and greatly reduced immigration levels, not unions.

      To ensure that the working man gets a fair shake and his fair share, accept that uncontrolled imports of Third World scabs and goods made cheaply in China are his worst enemy, and design trade and immigration policy accordingly.

  7. Been a union member since 1989. Got tired a long time ago them always preaching “VOTE NDP”. The NDP won’t help a business stay in business, but they will help you apply for EI and other government handouts. They just can’t comprehend that sometimes if you help the business, the workers won’t need EI.

    Don’t forget Roberts can be gotten to or is a squirrel like Kennedy.
    Roberts upheld ACA (Obugger Care) when even Kennedy was against it.

  13. With each and every incredible conservative (constitional) WIN! I become more and more convinced that GOD intervened in our world to SAVE America and SAVE the world.

    Just IMAGINE what America would look like if SHE had won? We would probably be at WAR with Russia AND China/Nork’s. Islamic Terrorism would be on the rise, not wane. The stock market would be in the duldrums. Unemployment would be high everywhere (except in government make work jobs). America would be completely borderless, with streams of Democrat voters flowing into the country. More and more corporations would be offshoring their manufacturing and onshoring their H1b visa holding IT workers.

    And the 2026 World Cup would be awarded to Venezuela

  16. If you don’t think that McCain and Flake won’t relish the ability to shoot down every single nominee presented by the White House, you haven’t been paying attention. Both these clowns, along with two or three other Senators will flex their spiteful muscles and make sure the 9th seat remains empty until after the mid-terms. I wouldn’t be surprised to see Rubio join them as well.

  18. Kennedy’s resignation ensures that the Senate will remain in GOP hands.

    Five of the Democrat Senators up for reelection are from conservative states. They won by posing as moderates, but then they voted with Schumer most of the time. Most voters in those states will approve of Trump’s pick for SCOTUS. So if they vote against the nominee, they will anger GOP voters and ensure they turn out in November. If they vote for the pick, they will anger the Democrat base. If Kennedy had retired a year ago, it’s possible voters would forget about their votes, but that’s not going to happen if there is a confirmation vote in the fall. They are in a no-win situation.

    It’s wonderful.
