The judge states all the facts about this terrorist - gives all the reasons to justify why the Crown is asking for two consecutive life sentences - but NO! We're in Canada, you see. We can't be seen to be like those awfull Americans!

This terrorist as_hole was building bomb parts intended for the killing of his fellow Canadians - our soldiers in Pakistan. That is not only terrorism but treason.

How could this judge give him this light sentence? To his credit though, he did not grant this puke double time for his time in custody pending trial. Fifteen years is not near long enough.

Posted by: a different bob at March 13, 2009 11:12 AM

It certainly looks like our existing terrorism laws and procedures work with one exception. As is too often the case in Canada, the sentencing judge was soft.

This Khawaja bird should have received at least 20 more years in addition to time spent in jail awaiting trial. He built a remote triggering device for use in bombs that would have indiscrimninately killed innocent people or (as Khawaja hoped) possibly Canadian soldiers in Afghanistan. He knew what he was doing and why -- he is a committed jihadist. As such he is an enemy of Canada and we needed to make an example of him in this first prosecution under our anti-terrorism laws.

Judge Rutherford failed to do that with his sentence that will see Khawaja eligible for parole in 5 years. Once more Canada appears soft on terror. The Crown must appeal this ludicrous sentence.

after he is paroled maybe the halfway house should be judge rutherfords home. another example of why we need elected judges in this country. lock rutherford and khawaja up and through away the f...ing key.

Police now stop Canadians at will and without reason. Canada has a legal system not a Justice system. Where are the lawyers with integrity, crying out for change?

Crickets.

Back in the days before the body politic was terminally infected by "progressivism", a threat to the Queen's sovereignty or the safety of her realm by someone who was under her protection (ie. a citizen or landed immigrant) was acknowledged as the most serious possible offence and was treated accordingly. Practitioners of treason were executed.

In today's "progressive" societies, we have admitted or raised thousands, if not tens of thousands, of persons who have no loyalty to the Queen, who threaten the security of her realm, most of whom will never be made accountable in any way to Her Majesty and some of whom will go on to cause great death and suffering within the realm. Many more will be less active, but nonetheless facilitate active treason. Instead of finding and prosecuting them to the full extent of the law, "progressive" Canada will harass citizens who call this madness into question, will force them into parallel and unaccountable legal structures, such as the kangaroo HRTs, will punish them through processes which are throroughly against real human rights, and will ruin them financially and socially.

Conservatives excoriate Pierre Trudeau for much of this decline in our character as a nation, and he certainly is a worthy (or perhaps unworthy) symbol of it, but we should remember that he reflected the temper of his times, and the mood of the post-WWII liberal academic and media elites who are still predominant in the state and cultural apparatus.

If I remember correctly his jihadi co-conspirators in England had planned to set off a small initial explosion to lure the curious outside so that a second much more lethal bomb could do maximum damage.

Khawaja’s father is the excellently named Mahboob Khawaja.

With a little luck, the in-prison justice system will take matters into their own hands in dealing with this puke Khawaja.

Their version of the Faint Hope Clause is designed to deliver a sentence such that there is a "faint hope" that he will survive his term.

I agree EXCEPT that I don't let Trudeau off the hook one iota: he was an uber-elitist and the others happily followed him—taking all the rest of us common sense, law abiding citizens of this country over the cliff with them. (Except that the elites have lots of ways, not available to the rest of us, to insulate themselves from some of the worst depravity they’ve enabled over the past three decades.)

It was the pro-life/pro-family crew that loudly—well, as loudly as they could, with the MSM completely either overlooking or ridiculing them—protested, and predicted the sorry state to which the Charter would bring this deluded dominion.

This latest travesty makes my blood boil: the inmates are running the asylum. ‘Bad, bad times are up ahead—it seems in inverse proportion to what one actually deserves. Kyrie eleison.

Peter Puck will serve 20 straight years; no parole.
Puck should immediately serve up the Islamic defence; confess he is a Muslim; get out of jail free.
But, where will Puck get the bread to pay mouthpiece Lawrence Greenspon?

As I have mentioned here many times before, we, the people of Canada, do not have a legal or justice system, they do. It is and hasn’t been of any relevance to the average person for decades, just pay and go away.

If you want satisfaction go to a whorehouse, if you want to get f--ked go to a courthouse.

Had this been a white dude building a detonator to kill women at a University the punishment would be quite different I suspect, and justifiably so.

I feel that a crown prosecutor and a judge would have no problem throwing the book at me for some petty white collar crime, and I would rot in jail for years after a loser like Potchey has been released. We live in a country where there are two sets of laws, oppressive laws for white men and PC laws for the rest.

I have never liked the idea of elected judges on a philosophical level. But, with a clearly established trend in Canada of light sentences for obviously heinous crimes, I'm beginning to see cracks in the foundation of my beliefs in this regard.

I don't know if there's a middle ground, but somehow judges need to be made accountable for these decisions.

Well, let's hope that he winds up in Millhaven, down on "J" wing.......ooooooops, honestly, I only turned my back for a minute, I have no idea how that Hell's Angel got his hands on him.....

You know it is a sad state of affairs when one has to rely on hardened criminals to mete out justice.

It's too bad the media and bloggers largely ingnored the Khawaja story. Very, very interesting story.

I suspect it was ignored because it is a multiculturalist's worst nightmare: a "Canadian" born and raised with a murderous hatred of the western society that so charitably took his family in when they wanted a better life. Who worked - with a security clearance - for the feds, at Foreign Affairs, no less.

Another reason why it was ignored is because it validated what the "tinfoil hat brigade" had been saying for years: that Canada is part of Project Echelon, which merely eavesdrops on every phonecall and email made in the Anglosphere.

Not only did events of recent years cause the USA and Canada to acknowledge Project Echelon, they trumpeted the arrest as the first one based on "passive" intelligence gathering, i.e. flagging emails and telephone conversations that are suspicious.

The Toronto 18 "terrorist" "plot" was a farce. Khawaja was the real deal; too real, apparently, for some. Damned shame everyone is obsessed with Obama and Guantanamo.

Posted by: Aluminium Toque at March 13, 2009 12:39 PM

Canada does not have either a legal or justice system; we have a legal industry.
We need elected judges and non-lawyers in the system en-mass. The closed elite club is getting too far removed from the people it is supposed to serve.

Posted by: Gunney99 at March 13, 2009 12:46 PM

Apparently the judge did not state in his findings that he allowed something like a 2 for 1 as regards time served. However, with only ten years laid on, it would seem like it was his thinking process and he reduced what should have been a much more severe sentence by about that amount anyway.

Is this going to be the judges reaction to public demands that double time for time served be stopped - just do it anyway without commenting that it is really a part of the decision?

A very big reason this case has been ignored over time is that so many of the pertinent details were under lock and key - how were we supposed to know what was really at stake and we were left to come to conclusions based pretty much on emotion.

The most recent details released seemed to indicate that yes, this guy was for real and what he did warranted a whole lot more than ten years.
Time we look at elected judges but we can't even get to the HRCs/IRBs, never mind the judiciary.

On another front, what the Kadhrs have been about has been fairly well known and certainly not ignored. In the final analysis, let's see what the judiciary does with this as it certainly looks like it is going to end up in Canada.

Rather than continuing their normal practice of allowing ordinary criminals “walk”, this far-left bias, terrorist sympathizing liberal judge decided to allow this terrorist to have a second attempt at slaughtering our children in a very, very few years, no doubt.

How many of these cases will it take before our politicians, including Harper and the rest of the liberals in the Conservative Party,to start exclusively appointing small-c conservative judges?

This is the type of ridiculous sentencing that encourages people to start talking about the return of the death sentence.

Canadians are one day going to have a very rude wakeup call in the form of a terrorist attack in one of our major cities..it is just a matter of time.

When that day comes, more than any other nation , i think we are going to see the true hockey mentality they posess, and God help anyone who gets in their way.

Canada has ALWAYS been a nation of warriors, and

You should all be aware that this guy not only had electronics to build bombs but also had an arsenal of weapons including cases of ammunition, a library of terrorist material and even a human target effigy on the rec room wall.....Now,tell me his parents were not aware of his "hobby"??? These facts of course were not brought to light at the trial,I am told.....What a bunch of idiots we must seem to be on the world stage.....And the RCMP??? They are more concerned with their image and stapler attacks than terrorists

...it is about time we started acting like we mean it..this game is for keeps folks!..

Posted by: Kursk at March 13, 2009 1:32 PM

Khawaja lived in his parents' large, expensive home in the Orleans section of Ottawa where he was arrested, much to the shock of Ottawa residents and civil servants. I suspect that within five years, he will return there and be hired once again by the civil service. He will take precedent over other applicants because of the civil service policy called "employment equity". Go figure.

I have long observed this foolish peer-appointment of judges.....
No competant lawyer will become a judge....he is simply making too much money....however the mediocre fill the ranks.....
And become politicized, incompetants on a power trip.......

lookout,

I'm sorry if I gave the impression I was letting uber-elitist trudeau off the hook for the madness around us today. Far from it; he had significant responsibility for much of the dumbing down and political correctness that has taken place in thid country in the last 40 years or so. My only point was that he had a lot of help from fellow travelers in the media, courts and legal profession, universities, secondary education system and other key institutions. These folks were beavering away at deconstructing our civil arrangements well before trudeau arrived on the scene and they continue today. There were also a lot of us who lived through his era, and I include myself here, who didn't do enough to stop him and his acolytes. Now we reap the whirlwind.
