A Public Shaming Doesn't Go As Far As It Used To

The Human Rights racket has hardly skipped a beat, despite the humiliation suffered at the hands of the Levant and Steyn fiascos. This beauty comes to us courtesy the Saskatchewan HRC.

The essence of the discrimination ruling appears to have occurred at two points near the end of a heated exchange. During that afternoon of June 8, 2006, Pontes was angry that Tataquason had been there for more than an hour, drinking coffee and talking to his wife while she worked. Tataquason testified that Pontes told him; "Can't you see she's working? Get out, this isn't the friendship centre!"

At other points in his testimony, Tataquason instead used the words "friendship inn." Saskatoon's Indian and Metis Friendship Centre is ethnically based while the Friendship Inn is not. The distinction was not noted in the ruling by tribunal member Donald Worme.

The other remark came as Tataquason was being escorted out. Tataquason told Pontes he'd "contact the chiefs and complain about the way Mr. Pontes treated First Nations people."

Pontes told Tataquason to "go ahead and call his chief."

Tataquason said he was "deeply hurt" by the remarks. It caused him to "trigger" memories of residential schools he has tried to bury since childhood. Tataquason testified that he "spiraled into depression," leaving him unable to work. The remark is also responsible for his return to drug use, his marriage breakup, his homelessness and his committing petty crimes, Tataquason testified.

His then-common law wife, Roseann Durocher, testified it also caused her to return to substance abuse. She testified she "wholly believes" Pontes evicted Tataquason because of his race.

But there's more - the tribunal member who handed down the ruling is Donald Worme.

Don's legal practice has been focused primarily on those issues that impact Aboriginal people individually as well as on issues affecting First Nations governments and entities. He has been active in promoting and protecting both the collective rights of Treaty First Nation people, and defending and advocating the individual legal rights of Aboriginal people in numerous legal and public forums. Social justice issues, primarily restorative justice, for First Nations people and communities remains an important focus on Don's legal practice.

Pontes has been ordered to pay $7,000 - and he says he ain't going to.

I agree - "Congratulate John Pontes on being one of the last men with a functioning set of balls in all of Canada:"

The Cataquiddick case looks stronger by the day.

My balls work fine TY; but, I would prefer not to be neutered at the hands of the HRC. Although I admire this man's balls at a distance, he soon might be admiring those who've managed to retain theirs.

What is the "booty" in heaven for a ball martyr anyways?

Posted by: Indiana Homez at February 2, 2009 4:11 PM

This could be really good . . . one patriotic Canadian to stand up to the HRC nazis and refuse to move to the back of the bus - a great white north Rosa Parks moment.

What will they do - send in the RCMP ? This will be a great story that the CBC will not cover fairly.

The greaseballs that run the HRC's will crap their pants when someone shines a bright light on their disgusting operations.

He'll need a good lawyer and a PR support team.

I'm happy to see he won't pay. A good way to highlight this latest welfare scam conducted by these Commissions. I agree with Melissa, if I weren't so damn far away his bar would be my new watering hole.

This man is standing on PRINCIPLE, Indiana. Canadians have been overwhelmed by PC stupidity, engineered via the 'guilt complex' foisted on the Greatest Generation because they appreciated the prosperity following WWII so much that they felt uneasy, undeserving and guilty about living in the prosperity that they had earned. They spoiled their offspring and catered to every sob story that came their way...from the goodness in their hearts. The country was run by the Greatest Generation until the late 70s and by then every never do well in the vicinity knew that Canada was an easy target.

Mr.Pontes is obviously a man who choose to not use silly, stupid rose colored glasses to look at his fellow man. He is SO right to not pay that whining fool who lolled around in Mr. Pontes's restaurant badgering one of Mr. Pontes's employees. A employer/employee contact is an agreement in which an employee exchanges their time for pay. The exchanged time is the employer's time and the employee is required to do the work agreed to at the time of the contract agreement. This time honored exchange has been twisted by Unions, unions have ruined this country, IMO.

I will be sending Mr. Pontes a thank-you note. Thank-you for posting this Kate.

I wonder if Catmeat Kinskilla frequented any Portigese resturants in his self portrayed 'blackguard, squallid' days of Yore.

Jema54 ditto to what you said.

Had my tongue in cheek.

I was stating my concern for his well-being. I believe many people in his position would like to do as he is but self preservation takes priority. The fact that I appreciate his sacrifice goes without saying. That being said, I don't think it is as easy as saying "I'm not paying". These HRC's can ruin you financially and criminalize you if that tickles their fancy(so I understand).

Posted by: Indiana Homez at February 2, 2009 5:05 PM

IH,

They can't ruin you unless you a) play along (by hiring lawyers) and b) give them your money.

Life is actually much easier than people make it out to be. You just have to CHOOSE to do the right thing and you will be amazed at the results.

Also, you have to be a stubborn big mouth like this guy clearly is.

There is a reason my HRC book is called The Tyranny of Nice.

Canadians are altogether too concerned with "self preservation" and not enough with principles.

Posted by: Kathy Shaidle at February 2, 2009 5:08 PM

"What will they do - send in the RCMP ?"

That's exactly what they did with the farmers who crossed the CWB. Does anyone think the RCMP would hesitate to do the bidding of the government? Read Palango's book, 'Dispersing the Fog'.

Face it, the human rights racket, along with the immigration hearings racket, will continue unfettered because they're make-work projects for lawyers; not the sort of lawyers who make sure everything is in order when you buy a house but the sort who are always on the lookout for the next taxpayer funded gravy train

They can put a lien on his property and then seize it and sell it at action and then realease what's left to him or they can have a warrent issue to have him arrested for "failure to comply" one HRC did this to the man who had a mental disorder and locked him up twice I believe? Oh they'll go after him and when they do I hope the media is awaiting to video tape the fascist tasdards.

Tataquason said he was "deeply hurt" by the remarks. It caused him to "trigger" memories of residential schools he has tried to bury since childhood.

What happened to his settlement for going to the residential schools? The Bet he & his crack Ho went threw the funny money like a snowmobile slicing snow. Now there onto another scam to keep the habit going in the style they have become accustomed.

Since when does being told to leave a place of work make you a drug addict or homeless?
It must be his hurt feelings, this criminal drug addict. I wonder how his multiple victims felt? The law stands by while the real victim is taken to the cleaners. Canada who stand on guard for thee. This guy native or not is a total leech. Dollars to donuts it was the lawyer looking for money that forced this stupidity. Mr. Pontes needs to counter-sue and make sure he has a psychiatrist as expert witness, a real MD board certified one, who can demolish this low life malingerer's claim and the HRC together. And, good on him for refusing to pay the extortion money, it's as greasy a shakedown as the Sopranos would do.

When is Harper going to do something about this? It's not ignorable. I don't care how tenuous his position is, this is about basic civil society principles.

The who cat thing has made me he "spiral into depression," and left me unable to work. The remark is also responsible for my return to drug use (waaaaaay too much coffee), my wife being cranky, my impending homelessness and my having committed fashion crimes. I'd be willing to testify to this in front of a tribunal.

Have created this doctrine to destroy Individual liberty under the bleat of the Human Rights racket.

Where is Red ED?, Brad Wall or Harper. The quiet is disturbing.

Teach real Canadian history with civics at schools. Instruct a comparative religions course. Have more parent teacher input. Vet our educators. Reward the good ones , than fire the bad ones. Particularly the Administration wonks.
De-credit journalism schools unless proven they are not Marxist puppy mills. Leave the UN. Cut the funding o0f all organizations who do not promote Canadian values. Lots could be done, but the rot needs to be stopped before the divide is to great.
Leave the internet alone CRTC!!!! Yet another group that should be extinct as a government organ.

I would like to first warn the First Nations that the HRC is thier worst nightmare. Beware! They have you in the crosshairs.

The owner made a mistake in not having a policy that prohibited "domestic" problems in the work place. The Employee (Wife) should have been warned 3 times and than terminated if her husband insisted on stalking her in the workplace. She has support groups for such problems.

The Police & Security must prevent domestic violence from erupting, thus a treat to other employees.

BTW: Why the conflict of interest!

Posted by: Phillip G. Shaw at February 2, 2009 9:45 PM

Oh,egad. Was it the Friendship Inn or the Friendship Centre? At worst, it sounds like a bad attempt at a joke. Even if the guy had said "get the ***out of here you stupid ******," is this the only person told to screw off when they're distracting the employees?

So, one off colour remark sends this guy back over the deep end of youth privation, with his wife following close behind in the great angst of it all.

Sounds like the guy was on the edge already. OTOH, NOTHING SURPRISES ME ANYMORE!

In a similar vein the Toronto Sun has another multi-part series starting today, this one on the enslavement of girls for the sex industry. The one that Mark Bonokoski wrote before this was on natives. In both series the girls all were adopted from their earlier problem homes into nice families that cared for them yet in every case the girls, native and non-native, made the CHOISE to leave these nice homes and live on the streets, do drugs and prostitution and of course cost us taxpayers endless funds to look after these stupid people.

This situation is in many ways exactly the same. These losers and their armies of tax-funded enablers like Donald Wormy punish those who contribute to our society and reward those who don't.

I experienced this during the superbowl yesterday as well. I was wondering what to get for takeout, since neither my wife or any of my girlfriends can cook, and referred to those restaurants of my youth and we always had Chinese food during the football game. Than our little kitty cat Cheetah, not to be confused with our pet sea-kitty which lives in the fishbowl, climbed up my leg and I had a terrible flashback to a weathery, scraggy, leather-like, fell from the top of the ugly tree and hit every branch on the way down, nimkimpoopish looking face of a man who obviously was raised by a weak father, close-up and the words "and they put the pork in it, and the pork mostly resembled CAT" were clearly and precisely mouthed by the voice that which belonged to Liberal Opposition leader, MICHAEL IGNATIEFF'S Rovian-esque communications and war room director WARREN KINSELLA.

Needless to say I ordered a 3 piece meal with 2 ribs and a wing with gravy instead of the coleslaw @ KFC instead.

I don't think I could ever bring myself to eat at one of their restaurants ever again. And I would have Chinese prepared food at least 3 times a month, $120 a month. But never again after what Liberal Opposition Leader Michael Ignatieff's right hand man Warren Kinsella said about pork in Chinese food equalling cat.

Posted by: Glenn at February 3, 2009 12:24 AM

Does Catworm have vested interests - does he own shares in that restaurant he trashed and now he wants it subsidized so he has driven off any business they might have had in these tough economic times? eg. now that restaurant can sue the Canadian people because we allowed Catworm access to a keyboard and the Internet.

It is all the taxpayer's fault!! I hear it now. Coming down through 10,000 wocks. No voltage required.

Posted by: biffjr. at February 3, 2009 11:47 AM

Donald Worme's background and involvement is interesting:

"Don Worme was appointed a member of the Saskatchewan Human Rights Tribunal in November of 2001. Mr. Worme is a partner with Semaganis Worme & Missens law firm".

In 2004 he was acting as a lawyer for one of the families in the Saskatoon "Starlight tours" -"Stonechild Inquiry"

Later on he was part of the Ontario "Ipperwash Inquiry" - listed as a lawyer but NOT a member of the SHRC;

June 2008 he represented DUMAS in a case in Winnipeg.

Given his involvement in high profile cases, I believe he should not have been a tribunal member in this latest case due to a potential conflict of interest - perceived or real.

It is surprising that a member of the Sask. Human Rights Commission is free to continue in high profile law cases/suits at the same time he holds a position with the human rights commission.

I can understand the BMW now.
