Native occupation about to end peacefully when confrontation occurred between contractor and several young men, police say

In the real world we call this a home invasion.
The occupation was about to end peacefully around 4 p.m. when the subdeveloper entered the house and clashed with several aboriginal youths.

Sam Gualtieri, 52, of Caledonia, was found unconscious on the floor inside the home with at least four young men, his brother Joe, told The Globe and Mail. His brother was trying to chase them out of the house when they punched him, his nephews later told him.

"The Indian was striking him on the head with a two-by-four while he was unconscious."

Mr. Gualtieri was rushed to West Haldimand General Hospital with serious injuries.

"He's in and out of consciousness. He has a concussion, a broken nose, he's bruised all over the face. His teeth are broken. He might have fluid in his spine as well," Joe Gualtieri said.

OPP Constable Paula Wright confirmed there was a confrontation between a 52-year-old contractor and a "number of unknown young males" shortly after 4 p.m. yesterday near the building site where protesters from the Six Nations reserve were gathered.


Guess who gave them the green light?
While the province purchased the Douglas Creek site from the developer, builders who now become the target of protest should not look to the province for help, according to industry sources who attended a recent private briefing by John Burke, the deputy minister of Municipal Affairs and Housing.

Industry sources said that, last Friday, the final business day before the writ calling the provincial election came down, Mr. Burke said the province stands behind its land registry system and development approval process.

But he cautioned that native protests turn a construction site into police business, and even if the builder gets a court injunction ordering protesters off the site, the police will be cautious in enforcing it because their priority is avoiding conflict, the sources added.

"The message to individual developers was: Pray to God that your land doesn't get occupied," said one developer who heard Mr. Burke.


The Toronto Star relates a somewhat different (though equally sanitized) sequence of events;
Natives said the youths saw the builder enter the home and went to investigate. When they were attacked, they defended themselves.

As I said, where I come from, they call this a home invasion.

With the writ dropped, no better opportunity exists for the beseiged residents of Caledonia to turn this issue into Dalton McGuinty's worst election nightmare. You have 25 days, people - make them count.

UPDATE - According to the Globe & Mail, the noble savagelets defending themselves from an unconscious man did so while police stood by and did nothing.

Rights to private property are not something that will be bequeathed to you by the Canadian government. Stop waiting for it to just happen. These are rights that are taken and owned and defended by force if necessary by the sovereign citizen, and you as a free person do not need anyone’s permission to exercise them.

I have to hand it to the injuns though, at least they will put their money where their mouth is and actually stand up and fight for something. Having said that it is now time to bury those cockroaches once and for all.

As a Canadian,(from BC) I am so embarrassed by the lack of rule of law in Ontario. One dead Indian and the whole country goes into to turmoil. An entire town is living under terrorist control and the government and law enforcements sit back and do absolutely nothing. Now, a man defending his property is brutally attacked. My question: How many "whitemen" will die before ANYTHING is done?
This is one of the most important issues facing Canada today and everyone is sitting back, it's not in my back yard...
To follow a letter I copied from Caledonia Wake Up Call:

Mr. Premier:

You may not know or care but a man was attacked by natives in Caledonia today in his own house. This man may not live tonight.

Your policy of non-action has likely now cost a life of an individual who wanted nothing but to build a new home for himself and his family.

If it wasn't time up until today for you to step in and end these senseless occupations by Six Nations natives of developments in this Province it is now.

Mr. Premier, get off your comfortable ass and deal with this situation and deal with it now.

Since Land Management and Land Titles is the responsibility of the Province I want no longer to hear your stupid comment that it is Federal responsibility.

You control deeds, land management and the OPP and it is high time that you now find the spine to deal with an issue that has been yours from the beginning.

If there was no reason to come to Caledonia so far I think we now have a situation that warrants you coming here and apologizing to the citizens of this fine town.

I expect you likely will not respond to this message because that would mean you would actually have to deal with a real issue in this Province.

When I read this I was absolutely disgusted, not surprised, but disgusted. Have we become so afraid of being called "culturally insensitive" or whatever the buzzword is that we simply get out of the way of any conflict with "differently cultured" peoples?

I applaud the contractor for standing up for his rights even though the OPP are too cowardly to do their jobs. Despite what politicos tell the OPP they still must uphold the law. Allowing these Indians to run roughshod over the rights of Canadians is going to end up one way and one way only; with a white man in jail for defending himself from similar attacks by these savages.

I think it is high time Canadians started employing similar tactics in dealing with savages. We should blockade roads into and out of reserves in huge numbers and begin taking back what is rightfully ours. The aggressive attacks of these Indians have forfeited their rights to any treaties that were signed in the past and we should endeavour to reclaim all the lands of Canada for Canadians treated equally despite skin color.

This crime is the direct result of the fact that these renegades know that in Dolton McSlimey's Onterrible Native criminals/gangsters/racketeers have a Get-out-of-jail-free card signed by the premier.

Exactly. And that is the absolute injustice of the whole thing, for there is no way police would be taking the hands-off approach they have to date if non-natives carrying out any of the tactics employed by Caledonia natives. That roadblock of native reserves you alluded to, johnboy, ain't gonna happen. The police would SMACK DOWN any white folk who took part. Indians can dig up a frikin' road and beat a contractor senseless and they do nothing.

The concept of any nation besides Canada existing within Canada is what has brought us to this point. We now know that multiculturalism inevitably breeds ghettoization and cultural segregation and exclusivity. I don't know why we are continuing with "the experiment" any further given the disastrous effects being encountered worldwide. Are we so arrogant as to believe we will not suffer the same fate in time?

Interstingly enough, had this story had a differnt end result, there is no doubt the older contractor would be gooned by the police and crown prosecutor for defending himself.


I bet there were plenty of tools around the construction area that would have served him well as a defensive weapon. If six punks had attepted to attack me armed with 2X4s, there would be a few of them in hospital with nail gun wounds and the rest would have saw cut.

I'll take my chances with the empathy of 12 peers...but I'll be damned if I will sacrifice myself to some dystopian experiment in disarming civilian self defense. Some one comes at me he better realize his life is at risk....these punks had NO FEAR of their victim because they realize the state had made him a perfect victim who is not allowed to respond to criminal attack by natives criminals.

Can you not think of a more practical alternative in this post-911 world, KPD, pretending for a moment you aren't a left wing troll abusing the open comment privileges here? Here are a few off the top of my head:

-Boycott Ontario campaign: create website and buy advertising telling people not to buy Ontario products, invest in Ontario, or visit Ontario.

-Boycott advertisers in Ontario media that support terrorism eg Globe and Mail, Toronto Star.

-"Atlas Shrugged" strike - white males should stay home for a week and watch how the province breaks down without us.

The politics being played out in Ontario are IMO the lowest I've ever witnessed. What passes for leadership in the minds of the sheeple of that province is a joke and a disgrace.

Even if John Tory is a fool he has yet to be shown as the kind of lying, incompetent, corrupt corksoaker that McGuinty is. These liberals need and deserve to wiped off the political map and more.
Tory is nothing better than the lesser of two evils...... but that's a big improvement over McGuinty.

However satisfying it would be to go in guns blazing to reclaim ones legally owned property, you'd be very unlikely to enjoy it after you eliminated the terrorist occupiers. In theory a jury could find you innocent but expect the government to vigorously prosecute and make an example out of you. Look at how aggressively the Ontario government is going after Bruce Montague for refusing to register his legally owned firearms while ignoring much more egregious violations of the firearms laws at Caledonia.

The way to make governments listen is to cut off their funding and a tax revolt would be a much better means of dealing with the situation. Canadians have a constitutional right to security of the person and this security is supposed to be provided by police forces which are funded by taxes. At this point the residents of Caledonia are being denied their right of being secure in their own homes and this would be a very good reason to stop paying taxes to the Ontario government.

Under anti-terrorism laws in Canada it is illegal to fund a terrorist organization. The Caledonia occupiers meet all the criteria for a terrorist organization. The OPP is effectively serving as a security force for the Caledonia terrorists and thus is a part of this terrorist organization. Another reason to withhold ones taxes.

For those who are self-employed it is a simple matter to not pay taxes. If a large enough group of people did this it would get the governments attention. My guess is that the anti-terrorism legislation would be the most likely approach to succeed legally, but then I'm no lawyer.

Just a note here on what to say when you write your MP or MPP. This was taught to me by a political Party I belonged to back in the 80's, a mainstream party.

First,tone down the vitriol, make it businesslike, not a rant. Absolutely no swearing, the minute a Party worker sees swear words, the letter goes in the trash.

Make sure you mention that you WERE a supporter of the person you are writing to, but can no longer continue to support him due to.......

There's a mathematical formula political parties have figured out, can't remember the exact details, but they calculate that for every letter written, there are 100 disgruntled voters who didn't bother to write. So your one letter carries a lot more weight than you think.

One thing that really unsettles a politician is if you were a member of his Party, and send him your membership card with the letter, announcing your resignation from the Party.

Again , they know that for every letter writer, there are lots who feel the same way, but didn't bother to write.

I feel sorry for the people of Ontario, who seem to have no real choices in the upcoming election, they can vote Liberal, or liberal. Either way, the end result will be the same.

If voters cannot elect a Party which will uphold the laws of the Country, what is the sense of voting? You can see why, in the U.S., there are so many "citizen's militias". They may be a radical response to mistrust in government, but in the case of Caledonia, who could blame the citizens if they did take the law into their own hands, as they obviously can't trust the government to uphold the laws.

This event is a gift to John Tory (I mean no offense to the injured man), and if he has any intelligence he will run with it.

However, I agree with an earlier post that said McGuinty and Tory are pretty much the same. It's one of those elections that will make little difference, although I'd love to see McGuinty lose anyway.

As for the individuals suggesting boycotts with Ontario or warfare with the natives, get a grip and get some perspective! All that is required is that the police do their jobs, and it's not the police themselves who are at fault, it's their political masters.

The police force should not be a tool of politicians to be used to circumvent Canadian laws when it suits their needs. Let the police make an arrest/prevent beatings/killings etc and then I'd like to see a politician and or judge overrule that officers arrest of an individual.

Marie Trainer, Mayor of Haldimand County was just interviewed on CBC1. She reported that Mr. Gualtieri was moved to a Toronto hospital. Sounds like he is still in bad shape but stable. No word on any arrests.

I am not buying the idea that police are not at fault here. They have sworn to uphold the law, no one was pushing them to arrest Gary M and they could have at least arrested and charged the most violent criminals and let the courts and crown to sort that out. What I am hearing on the audio tapes released recently, is reluctance to do something. Why don't they dispute the orders, why don't they go public if that's against their principles? Because it is not! I yet have to hear about a rank and file cop speaking out against the cowardly orders given to them by their superiors.

Interviewing the local residents here and there in Niagara region, I cam to a conclusion, that the occupiers are playing with fire. Even before the Brantford and the latest beating, the common sentiment towards the protesters was 'just shoot them'. I wonder what feelings the people have now?

Okay, the chief Brant was not a legitimate representative of Mohawk when he sold the land, let's assume that for a moment. But the only way to resolve that situation in a civilized society is to go to court and get judge to issue a verdict.

They are terrorists by definition, starting from the Traditional chiefs council or however it's called and ending with young criminals who overrun the protest site so that even the cheifs are scared to be there. What is happening is not authorized by any legitimate entity in Canada.

The federal government has stated with no uncertainty that this is not a valid land claim.
They have also stated that it is a provincial matter.
Until the province leader admits he cannot handle the situation and ASKS the federal government to help - the federal government cannot interfere.
Up until now McGuinty has only blamed the federal government, and implied they should fix it - but not allowing them to by any means except at the negotiating table (ie pay enough $$ that it goes away for awhile).
With any luck a new leadership for the province would actually ask the federal government to take over the issue, and resolve it.
Until that happens, things will only continue to escalate.

Mark Peters, one of the problems the provincial "negotiators" is having re. their "negotiations" with the Douglas Creek Estates occupiers is that they are a leaderless rabble. There is no one in a position of power to represent the occupiers at the table. One guys says something one day, next day he's not there and some other guy says something completely different.

The group that is trying to charge builders for "permits" this last couple of weeks has nothing to do with any legally constituted governance on the reserve, they're just a bunch of guys "defending their land claim".

You know, the really sad thing about this is I don't even blame the natives! These are criminals moving into a power vacuum created by Dalton McGuinty, the run of the mill 6 Nations guy has zip to do with it.

This whole situation is pathetic. I will not vote for the weasel McGuinty. I will hold my nose and vote for Tory. I do not go along with publicly funding religious schools, but maybe just maybe the provincial government will be able to get a handle on what is taught in some of those schools. Maybe safer for the children of Canada to be in public schools with the immigrant children from the ME attending there own schools. After what happened in Russia wouldn't you agree it be better for them to attend their own little schools. Just trying to reason out what is making John Tory tick.

I actually think the natives are doing what we've taught them, which is simply that there are no repercussions for natives who commit crimes, such as assault. Had the law been applied during the first Caledonia uprising this never would have come to the fore.

Mark, the most important thing that can be said about this DCE affair in Caledonia and the new blocking of contractors in Hagersville, Brantford and Dunville is that "natives" have nothing to do with it.

This is organized crime. Lefties, Liberals and Mohawk Warrior Society spokes-swine would like you to think this is all about racism, land claims and the poor downtrodden Indian.

Nuh uh. This is about the expansion of organized crime that began with cigarette and dope smuggling and is now trying to branch out into casino gambling. The Douglas Creek Estates is next to Highway #6. This is where they want the casino. The principals involved lost every court case they filed regarding land claims on the property. Then they were outbid by the developer for the property. So they just TOOK it. They being a large number (like a couple hundred)of Mohawk Warrior Society punks from other reserves and from New York, NOT Six Nations reserve residents. Yeah sure, some local pukes were in on it. They didn't make it happen, they were along for the ride.

Additionally, the local government of the reserve ruled against casino gambling, the "natives", aka everyone living on the reserve, didn't want gambling. That local government body is now very quietly staying out of sight.

McGuinty knows all this. He's playing it as a stick to hit Stephen Harper with. He will not take any action against any "native" group so long as he can play this game against Ottawa.

Incidentally, the DCE site has been fortified. Lotsa concrete went in there, lotsa "archaeological digs" were done (with stolen back hoes) that oddly resemble slit trenches. AK-47s are on site, we know that for sure because somebody (a local reserve kid, figures) already got shot with one. What else they might have in there, one can only guess.

I don't think it is possible to overstate the seriousness of this situation. We have one casualty now and a provincial police force that seems quite happy for this to be the first of many. There's an excellent chance a bunch of people are going to die here, all because Dalton McGuinty is playing politics instead of doing his friggin' job.

Also, one the Mohawk warrior protesters summer '06, was Micheal Laughing. Whom earlier this year, was busted for drug smuggling near St Regis NY.

Tony also is involved with casino gambling in the St Regis area, and attempted to be part of the Seneca gambling operations in Buffalo.

Ken Hill of GRE (Six Nations cigarette manufacturing-Grand River)some time in the past, attempted to set up a casino in Brownsville Penn. USA, by claiming the land to be native. The residents there booted him out.

And for all you public education lovers out there; it is about time you take back control of your school board and eliminate the teaching of vice, nihilism, racism and ignorance. Trying to vote your way to a better society is what got you into this pickle in the first place. It is no coincidence that back in the day when you had less democratic rights you also had more property rights.

If voting is the answer then the question must have been - "How do I get my hands on my neighbour's property, and around half his income, and make him pay for his kids go to a wretched school with my kids?"

Not voting, then passively - but firmly - stating to anyone in government who asks that you did not "vote" for them to take away your right of self-defense, take away your money, or brainwash your children. When their claim to ballot-box legitimacy evaporates in the face of wide-spread non-participation, then so will your Nanny government. The smaller the army of losers which votes in losers-in-chief like McGuinty, the easier you will be able to ignore them when they come around to take what isn't theirs.

John Tory is not a viable choice anyways - just another Red Tory claiming that he can run the Nanny State "smarter". I wouldn't give a loser like that the time of day, let alone the excuse of claiming that he can steal my property because I participated in a government-engineered beauty contest.

Here's a little exercise I would like all of you to perform, in the next election you face. Look up the CVs of your local candidates and the party leaders, and check what they've been up to, say, since high school. How many of them have actually accomplished any real, concrete successes, outside of government? And how many of them have been nothing but weiners for their entire adult lives, working as bureaucrat for this, adviser for that, lobbyist for something else, trustee for a public council, and so on. And if they allegedly have been so successful in the non-government sphere, they why would they be so stupid as to run for public office when it's guaranteed that nearly everyone will end up hating them? (the taxpayers for taking too much of their money, the parasites for not giving them nearly enough of other people's dough) It's a lose-lose job, which is why you find losers and shiftless no-accounts to be the most enthusiastic aspirants.

Then, scan down the top-ten bullet list of their priorities. The first one will almost always be something like this: "I promise to keep spending in line/hold taxes low/be accountable for every dollar of taxpayer money". The following nine items will be a list of new and expanded welfare programs they promise to fund. (Remember however they're not called welfare programs, they're called "urgent priorities")

If you do this little bit of research and you can honestly say that you found a non-loser candidate whose party has a non-loser leader, and whose platform is not a just another attempt to buy the votes of credulous fools, then by all means vote for them. Just don't come around picking my pockets afterwards to pay for your non-loser politicians' fuck-ups.

I saw the daughter of the man who was attacked and almost murdered. I felt so sorry for her - imagine how she feels - her Dad is found in the house he was building for her beaten to a bloody pulp on the floor.
What was this man's crime? He was conducting his business on his own property. If the government of Ontario cannot protect tax paying landowners then they must give up the status of being a province in this Dominion.
Without security of property there is no need to pay property taxes - landowners in Ontario should appeal to the Federal government to protect them against the actions of undisiplined criminals who appear to be running the show. They should insist that they pay property taxes directly to the Federal government in the absence of any kind of protection from criminals by the government they have been paying their taxes to for that specific purpose.
Stalin used the tactic- terrorization of the citizens by ruthless criminals to keep the people shrinking in their state regulated cells; then they easy to control. The first actions of the Bolsheviks, in gaining control of the Russian people was; disarm the citizens. Sound familiar?
My heart goes out to the family of victum of this wanton act of violence. The men who are responsible are of the lowest, most cowardly stamp of humanity. I would like to help that family round up the thugs. If the people of that area can corner even one of them, please do so and hold him down so that the entire family can spit on him before he is turned over to the courts where he will evade any kind of Justice.

...while a noble gesture, we must work with what we have, losers or not. I feel that if more people got out to vote, then possibly the elected governance would feel two things:

1. More 'wanted'.
2. More accountable/responsible.

Look at the psychology of the matter. How'd you feel knowing that less than say 33% of the populace cares enough about the country and less than that percentage even voted specifically for you or your party?

If more people voted and you won even by a slim vote count, you know in the back of your mind that more people are watching your movements.

Ontario faces a strong delemna. If what you say is true about John Tory, then Ontario still can send a signal by coming out to the voting station en masse.

But alas, this may be pie in the sky. As long as we have wage disparency (hockey players getting millions of dollars a year in salary), lame duck courts and overweight social workers - well you make the bed you sleep in.

Gary McHale does not live in Caledonia, he is the only one that stood up and took a stand against the two tiered justice in Caledonia. Gary stepped up to the plate when all of the politicians failed the people of this town. This man was arrested for putting up a Canadian flag and spent the night in jail. Four "young thugs" beat a man nearly to death, oh, no arrests yet????? You have an OPP officer on TV telling the media that their there to keep the peace, what a bunch of bull.
Get passed the colors spends sometime reading on that site, simply some amazing stuff. Yet again try going to the video section and watch Shaune Brant's video that should get you blood pumping.
The issue here is there is a man beaten and the OPP are still doing exactly what they have been doing all along, nothing.

You're assessment is correct, Tomax. There is not a group hounding the government. There are two guys that stepped up publicly, neither of whom live in Caledonia. Gary McHale is the guy with the funny website, he's not exactly the leader type. Mark Vandermaas has Voice of Canada blog.

Both of these guys have been to the slammer already, without charges and chucked in the paddy wagon none too tenderly either.

People in Caledonia haven't really been inconvenienced recently... except for the ones who live next to the DCE occupation. They've been getting beer bottles thrown at their houses the whole time.

So what we have at the moment is a relatively calm populace who are waiting for government to fix it like they are supposed to, with maybe 150 people whose lives are getting wrecked.

There's an interesting phenomenon happening with real estate values in the area though, they are dropping while the rest of the Golden Horseshoe climbs steadily. This is not generally known except among the real estate agents, the MSM doesn't think people need to know that.

Dalton is not going to do squat just because one middle aged carpenter got the sh1t kicked out of him. He's going to cruise along the same course, because rightly or wrongly he thinks this is going to get him re-elected.

There's not going to be any vigilante justice right now, A) because nobody is that upset and B) because residents know the OPP will be a MUCH bigger nightmare than the occupiers ever knew how to be.

The natives however are getting restless. Their "leaders" have been quite smart in keeping things confined to the DCE. But these occupier types are basically punks looking for some action. They are bored and its starting to get cold. They are no longer content to drink themselves stupid(er) every night in front of the camp fire.

Thus we have this campaign to shut down all the building sites in Caledonia, Brantford and what have you. Gives the bruisers something to do, ratchets up the pressure on Dalton to let them have their damn casino, and opens the door to a nice little protection racket in the mean time.

Problem is, small contractors are not the kind of guys who are going to bend over for this, they can't afford to for one thing. These sites are all over the place, not next to the Reserve where 300 punks can suddenly show up. Small numbers of thugs are trying to intimidate equal numbers of guys tougher than they are with more to lose. Like their pay.

We have the perfect set up for mayhem. My fervent hope is that Dalton is a lot smarter than I think he is. If not, we are going to have full hospitals for a while.

IF this was the case then the situation is even more serious than previously thought, I would suggest. For the police aren't intervening even when crimes are being committed in plain view. I guess there really are two laws in this land.

Firstly: Maybe we should start a petition to the Queen, Her Royal Majesty, to remove McGuinty from his post. Perhaps, better yet, contact the Queen directly via e-mail and provide links to the scanner recordings, etc.
