Anybody see McCallum on CPAC? Peter van Dusen put him through a real grilling, and it almost laughable the look of terror on his face, not to mention the b.s. he was uttering. He's learned Lib double-speak very well. Always thought there might be a shred of decency in him. Oh well. No lawsuit - courts demand evidence, evidence contains untold horror stories of more Librano mismanagement. Start dem shredders, boys. This is only going to get uglier.

Isn't severance paid when the employer decides to let someone go?? Isn't it Dingwall the one who broke the contract? Shouldn't it be the government going after Dingwall for breach of contract? Just asking.

Giving them another three or four months to shovel a lot of money out the back door, and dispose of a lot of documents. (On Question Period tonite on the tube, the question was raised, (but not answered), about the removal of a hundred boxes of documents from Public Works, by the RCMP. My question: Did Alphonso Gagliano's appointees to the Mint, go along to help 'sort' these documents?

People are entitled to severance packages when they are severed by their employer, not when they quit voluntarily. Period. They are also not entitled to severances packages when they are terminated "for cause", for example theft of company property, breach of company policies, or fraud. This is common law. If the Mint put something in Dingwall's contract that he would be entitled to severance when he quits voluntarily or if he is terminated for cause, then that is equally scandaluous.

It's commonplace in the U.S. for the presidency to age a man (we haven't had a female president yet - we'll see what that does, may be more along Thatcher lines?), and at the end of a president's term, whether it's 4 or 8 years, there are always photo roundups showing how much he's aged in office. Usually it's kind of scary - Bill Clinton was an extreme example.

But how long has PM been PM - 18 months maybe? He looks like he's been hitting the Slim-Fast too hard. Of course there have been *all* the scandals but he had to know those would come home to roost someday - right? Right??? Sir, eat some Alberta beef, take a nap, quit reading the papers. I disagree with you, but you have far too much power in this country to be in bad shape.

Big pizza trouble again for Canadian minister

Another day, another extremely expensive dinner at a Toronto pizza parlor.

A day after failing to explain how he had managed to spend C$138 on pizza for two, Canadian Immigration Minister Joe Volpe was roasted in Parliament on Wednesday for spending C$207 on pizza for three people at the same establishment.

Volpe charged both meals to his expense account, prompting opposition Conservative parliamentarians to accuse him of wasting taxpayers' money. The ruling Liberals are trying to overcome the damage done by a government patronage scandal.

"I'm sure Canadians are getting indigestion just thinking about all that pizza," Conservative legislator Rahim Jaffer told Parliament, prompting a chorus of mocking catcalls, jeers and groans.

Volpe -- who said last month that some meals had been used to discuss affairs in the province of Ontario -- replied that he had been talking about immigration issues. Jaffer found this explanation found hard to swallow.

"The minister of immigration has eaten himself into a corner... Obviously the minister cannot remember which phony excuse to stick to. Which is it? Ontario issues, immigration issues or is the minister just out to lunch?" he asked.

Last month, government records showed that Volpe spent almost C$7,000 on 31 meals in one seven-week period earlier this year. The records showed that on one night, Volpe had two dinners, each one with a different group of people.>>> news.yahoo

SUBJECT: The definitive word on Dingwall's severance entitlement

Reader Mark in Ottawa directed me to an interview from this morning between CFRA Radio host Steve Madely and Howard Levitt, a lawyer at Lang Michener in Toronto, who is also the author of The Law of Dismissal and editor-in-chief of the Dismissal and Employment Digest. (You can hear their talk here, directly, or here if the first link doesn't work. Scroll down to the post "Should Dingwall Get Severance?" But you must have a media player on your computer that will play MP3 files.)

Yesterday in the House of Commons, Revenue Minister John McCallum (who I must say, again, takes incompetence and fecklessness to new depths each time he speaks), claimed that the Royal Canadian Mint Act, the Financial Administration Act and "the crown corporation general regulations" all required the government to pay former Minthead David Dingwall generous severance after he terminated his employment contract prematurely. (McCallum's remarks are here.)

When Madely asked Levitt if this could be true, Levitt, who is considered by many to be the premier expert on severance in the country, said flatly, "What McCallum says is patent nonsense." There are no general, universal obligations under Canadian law to pay severance to those who leave of their own accord.

According to Levitt, if anyone of us quits his or her job voluntarily "that's the end of it. We've terminated the contract unilaterally and there's no mutual obligation" that binds our employer to pay us compensation for leaving.

At the end of the interview, Levitt concluded if Dingwall's resignation was voluntary "and not in return for an agreement, then he has no entitlement to any pay whatsoever, either statutorally or at common law."

If Dingwall had been demoted or transferred in hopes he would get disgusted and resign, or if he was told to resign or be fired and he and the government chose, euphamistically, to call it a resignation to enable him to save face, then, Levitt says, Dingwall might be entitled to compensation. But since none of these seem to pertain in Dingwall's case, Levitt explained that none of the ordinary triggers for severance apply.

Did his signed employment contract contain a provision for severance? No. So Levitt reiterated that there is no case law nor any statutory law that obliges Ottawa to pay the former Mint CEO even one of the nickels his organization produces.

Is there any circumstance in Dingwall's case that might compel the feds to pay him severance, Madely asked? Yes, said Levitt. If the government agreed to pay him severance to get him to leave, then he would have a case. The deal could be written or merely oral. It could have been made in a telephone call from the PMO or from McCallum. Then, there would be a legal obligation to pay.

But then the obligation would be the result of some shadowy backroom deal, not some legal requirement.

My guess is that what the government is trying to do is cover up a deal it made with Dingwall after his expense and lobbying controversies broke. The obligation began then and only then. There is no "Canadian law" compelling them to pay out, but rather a expeditious little arrangement they made with the Dinger to get him to leave quietly.

Their repeated appeals to the Privacy Act, too, are part of a one-two cover-up punch: We have to pay Dingwall out, the law says so, but we can't divulge to taxpayers (who are footing the bill) just how much that severance will be, because the law also forbids that.>>>
