The Post Millennial- Supreme Court rules against EPA’s authority to limit emissions by remaking energy sector

The Supreme Court on Thursday issued a ruling in the case of West Virginia v. Environmental Protection Agency. The 6-3 ruling sides with West Virginia, which sought to limit the Clean Air Act.

“Capping carbon dioxide emissions at a level that will force a nationwide transition away from the use of coal to generate electricity may be a sensible ‘solution to the crisis of the day,'” Roberts writes, citing New York v. United States. “But it is not plausible that Congress gave EPA the authority to adopt on its own such a regulatory scheme in Section 111(d). A decision of such magnitude and consequence rests with Congress itself, or an agency acting pursuant to a clear delegation from that representative body.”

  1. Sadly … the SCOTUS has already agreed that Co2 is a “pollutant”. Horrific decision underpinned by faulty models and fudged temperature data. The SCOTUS shockingly treats the EPA as a legitimate “science Agency”. Meanwhile … lead contaminates drinking water in far too many localities.

    1. No one has explained to my satisfaction how carbon dioxide is a pollutant.

      This vexes me.

      1. The claim is that if it causes harm to the environment and to humans it is a pollutant.

        The claim is false of course, because the science is very clear that CO2 causes no harm to the environment, quite the contrary, increases in CO2 are a benefit to all life on earth including humans. They lied to the court, guilty of perjury.

        The SCOTUS decision that CO2 is a pollutant is thus based on a massive lie. But it will stand until somehow, honest scientists are able to show an unbiased SCOTUS the facts. Don’t hold your breath.

    No reason for progressives to be angry at the last two weeks. Their president is the most popular in history. He should easily get the votes to pass law in their favor.

  3. The EPA’s powers are extraordinary; basically they can make law unilaterally without legislation. It matters not how many lives they ruin in the process.

    Those powers need reigning in. Badly.

  4. Every single decision of the last week has said to amend the constitution or pass a law to justify your stupidity. It’s not the job of the Supremes to create law or amendments. The Constitution has been amended 27 times. It can’t be all that difficult. Just find something the country generally agrees on. Wasn’t that the whole point?

  5. Many of these ruling have a theme: the primacy of legislation over the courts and deep state unless there is a clear constitutional right.

    1. And when those Legislator’s pass laws that drive up the costs of all basic goods ,.. the people will replace their asses with smarter, more compassionate people.

  6. I read somewhere once that the EPA actually issues grants to environmental groups so that they can afford to hire competent lawyers to sue the US Govt. State Govt., and even the EPA itself to change policy and circumvent the Legislative process. It’s pretty telling that they want to shy away from representative government so as to give certain politicians cover for destroying entire industries or keeping those who are (presumably) represented in the dark about the nefarious agenda.

  8. Did the majority wipe out the Chevron Deference, and it’s related abominations?

    Or the EPA’s illegal and illegitimate “Fund, Sue and Settle” regulatory regime?

    Obviously there is still work to do to rein in the regulatory agencies.
