Today, Bruce Hughson of the Department of Justice forwarded a notice to the Federal Court concerning our case against the Attorney General of Canada. The notice is to inform the court that the government has invoked Section 39 of the Canada Evidence Act. This is an action that the Clerk of the Privy Council can take to “make secret” any materials the government doesn’t want the public to see. This puts the materials, in this case the government’s evidence, beyond the reach of anyone, even the courts. Supposedly, this sweeping power is exercised when the material is so sensitive, it is against the public interest to disclose it.

The certificate invoking S. 39 was signed by the Interim Clerk of the Privy Council, Janice Charette. Keep in mind, in late May, Judge Gagne ordered the government to provide its evidence to her alone, not the public. She would then evaluate if the materials were too sensitive for public disclosure. It appears that the government believes the evidence they used to ban up to a million firearms owned exclusively by licensed gun owners is too secret (or dangerous) to have even a federal judge view it.

    2. Canadian judges aren’t worth a plugged nickel in cases such as this. I suspect the worst that will happen is that the judge will issue a stern statement about the refusal to provide the requested documents, then find some reason to dismiss the case on the grounds that the government has declared it all super duper secret. Or some other “legal” reasoning that is utterly morally bankrupt and lets the government do whatever it damn well pleases because that’s how this silly country works.

      I’m not sure Canadian judges are ever worth a plugged nickel, to be honest.

      1. Well, to get pertinent numbers, the Liberal donation list was always a good place to start.
        The last 5 years have of course left the Libranos pretty flush, so petty donations no longer needed.
        Besides, you only need 5000 sales in Canada for a bestseller, requiring huge advances for lucky Librano authors.
        Race, gender and sex now rules the anything but blind “justice” system.

  5. Apply to a court for an order obliging the government to have a judicial review of that decision.

  7. If the judge had any sense, they would immediately rule that S.39 is unconstitutional under the POGG clause of the Charter, and reiterate her demand, along with an arrest warrant for the privy clerk.

  8. So, if a judge has to judge by the evidence, and the crown evidence is not being presented, does that mean the judge must judge by the evidence provided by the petitioner alone?

    There are many ways to conceal your firearms. Educate yourself and keep them. You are going to need them eventually.

They don’t understand nor represent people from the west who use firearms in their daily lives, and they immediately silence anyone on their social media who dares to discuss using firearms for self defence despite the fact it’s a legitimate concern.

    The only response from firearm owners should be mass non compliance. In the highly unlikely event The Tories ever form government again, they will never reverse Trudeau’s gun laws with the current slate of losers that call themselves Conservative MP’s. The only way for a reversal of the Librano’s gun laws is for Saskatchewan , Alberta, etc to secede from Canada.

  13. Methinks the evidence indicates that the gun registry data is alive and well in contradiction to previous orders of parliament and the courts. Such an overt act of criminality by the government would have to be deemed “secret” in the national interest.

    How many magistrates and judges, all the way up the food-chain, are ex police prosecutors?

    How many have strong “social” links to the terminal statists in the Parliament?

  15. Buy as many guns and as much ammo as you can. Have a plan to hide some of it for the day the shit really hits the fan in Canada. 5 years ago I’d have considered the foregoing to be paranoid nonsense. Things have changed a lot, and are accelerating.

      An astounding claim of “Success” from the idiots who insisted there was about 21 million long guns in Canada ,before their Multi Billion Dollar Boondoggle.

      1. Yeah JR, I remember those numbers about the amount of guns in Canada before Rocky had his bright idea. The piles of guns that suddenly didn’t exist, could be a mountain range by itself. We could call it “Buyback Mountain!” Rocky wouldn’t be impressed. I mean Allen Rock, not the Rocky Mountains, The Rocky Mountains would be impressed and dwarfed, with the Buyback Mountain.
