Eliminating Reasonable Doubt

That’s the goal of the prosecution in the Chauvin trail and they’ve just about finished making their case. Then the defense gets their turn.

The Law of Self Defense Blog Day 11

First, the state has to prove that Chauvin’s conduct was a significant contributory cause of Floyd’s death—that would be sufficient for the third-degree murder charge. Even the other charges do not require that Chauvin intentionally killed Floyd. Apparently not even the prosecution believes this was an act of intentional RACISTPOLICEMURDER!!! Or we would see an intentional killing charge in this case, and we do not.

A second condition that must also be met in order for that conduct that may have made a significant contribution to Floyd’s death to be a crime—the conduct itself must in some manner be legally wrongful.  If the conduct was lawful, it cannot be the basis for criminal liability.

It’s a good recap of what’s been going on. Have a look.

    1. If he is found innocent, they’ll just do a Stacey Koon on him.
Political correctness trumps Double Jeopardy as much as it trumps Reasonable Doubt.

    2. Although I believe Chauvin is innocent of the charges, I sincerely doubt a jury (that has been tainted by the lying media and a whopping settlement) will acquit him. Regardless of the outcome, there are going to be riots and the city will burn.

      1. Agreed, but he will be made an example of, because wokeness and feelings.

Despite the fentanyl OD, which Giant George admitted to, “I swallowed too many drugs”, the community wants a dead cop, they won’t be happy with manslaughter, but it’s the best they will do, and unfortunately, that’s what Chauvin will probably get. In the eyes of the progressives, the cops should have let George go, cuz black/feelings/cop hate, and pick him later when he was passed out. Besides, being a drugged out ex-con is just another lifestyle choice, what’s wrong with that anyways? /sarc

    3. Ben Shapiro points out that the prosecution is basically showing that they have no case.

But I have to wonder, will the jury convict him anyway? Maybe out of fear?

I think it’s obvious that there will be riots for any verdict that doesn’t execute him.

    4. @james:
Well you seem to believe any bullshit so that means you have shit for brains.

      1. Nice recitation of opposing evidence and views. And are your eyes brown, or are you a pint low today?

      2. No one can prove that this might have been a RACISTPOLICEMURDER!!! because know one truly can know what is in the heart and mind of another.

      3. Nice to see your ignorant and stupid presence today. Get stuffed, FOAD you Liberal Maritime welfare case

  1. The “Faith in Juries” ship sailed long ago. It left the dock Oct. of ’95 and hasn’t been seen since.

    1. Your right.
With the invention of cellphones, you now can gather groups of people together in a few minutes or keep anyone in constant surveillance which our mainstream media loves to intimidate people into submission.

Works extremely well on our politicians…
Monkey flip next time Trudeau, they’ve already made you look stupid in bending a knee to an extremely small organization.

    2. Two words: Jury nullification

All of this intelligent, analytical, breakdown of the charges and the evidence will be for naught after one or more jurors decide they want to PUNISH whitey. Allow me a personal story of being on a jury … prior to the OJ Trial.

It was a case of assault on a police officer that almost ended in a cop killing. The white supremacist, meth-head, loser criminal bull-rushed the officer, got the cops gun and almost killed him. A black, retired veteran, intervened and saved the (white) officers life. The case was cut and dried … attempted murder of a police officer. We got into the jury room, took an immediate (secret) vote and it was 11-1 to convict on all charges. We asked if the ONE no vote would reveal themselves and explain their concerns. A young black woman raised her hand and explained that … “cops always be hasslin’ my cousin, for no reason.” “I hate cops.” “I don’t believe anything the POleece say”. “All of their testimony was lies.”

Wow! Well … she was sure a juror of the criminal’s peers … dumb as a box of rocks. After some young white female in the jury pool UNLOADED on the utter stupidity of the black woman’s idiotic “deliberation” … the black girl relented and we sent the mofo to Prison for 25 years. This STUPID girl was willing to let a white supremacist criminal go free … because “the POleece always be hasslin’ her cousin.” She could have hung our jury.

I fully expect NO VERDICT in this case. There will be two camps in the Jury … and neither will give. This will be a hung jury

  2. Yep. The guy had triple the median dose found in people who died of overdose. The jackass ate his stash. The bizarre testimony of the coroner said it was caused by interaction with police when the guy didn’t have a bruise or a scratch anywhere near his neck. I suspect that defence witnesses are going to make the coroner look like a fool. I wouldn’t be surprised if he gets called back after the defence witnesses eviscerate him. He was clearly singing for the district attorney. I guess he likes his job.

    1. I also think the jury are intimidated. If he’s found not guilty, they will also be under threat of death from the mob. Chauvin may be a thug, but he didn’t kill Floyd, yet there seems to be an aquiescence to the mob these days, so I wouldn’t put money on an aquittal. I also agree with others that there will be riots if he’s aquitted, and riots elsewhere if found innocent, because the mob already know they can get away with it, on the flimsiest of excuses, as per Portland and Seattle, but don’t you dare meander through the capital building….Our societies have fallen a very long way in a very short time frame. I don’t think climbing back is any kind of option.

  3. Talk about lies.
This is on CNN 7/24. Only people talking about it, have hate for the officer. Nothing about what really happened.

  4. *
minnesota’s gonna burn to the ground…

“The officer who fatally shot a 20-year-old Black man outside
Minneapolis Sunday appeared to have inadvertently pulled out
her gun instead of a taser
    , police said.”

of course, none of this would have happened if he hadn’t
    decided to fight & flee.

    hmmm… that sounds so familiar.

    *

    1. Or the officer saw he was belligerent and asked herself am I gonna survive what he’ll do to me if he’s hopped up and can shrug off a tazer like Rodney King did?

Note – I know little about the case. Did she have a lot of backup, or could it have been her life if the first shot (of a tazer) didn’t keep him down?

  5. And now, another idiot got himself killed by police, what does our comrade governor have to say….

“as our state mourns another life of a Black man taken by law enforcement.”

Hey Waltz, why don’t you just use the term murdered and go lead the riot.

    1. Well, the cop did admit she meant to taser him but pulled the wrong weapon and shot him with her gun. So there’s that…

      1. Definitely a training issue or a very stupid cop. Regardless the city is to blame in either regard, we should see more of it on the race to the third world.

        1. Or perhaps a cop who was scared to death of the situation and the fact that it’s pretty much open season on cops.

          1. Yea, well if that was the issue someone in HR should recommend she learns how to build solar panels like they like to tell oilfield workers.

  6. When the state takes one of it’s own witnesses who “testified incorrectly” out of the courtroom to “correct” his testimony you know it’s Banana Republic time.

  7. She took out the wrong tool , and shot the MoFo, now that’s some funny shit rite there:-))))

  8. I do not care what the verdict will be.
    It does not matter anymore.
First the thugs are going to riot, inside their little protected enclave, hurting themselves their friends and neighbours..Just get me the best drone coverage evah,so I too may enjoy Democrat Wisdom.
If they cross into “Real America” just keep those drones flying cause I will be laughing my ass off.
    The message sent to the rest of us,is this;
    Justice is dead.

The presumption of innocence, the right to be tried by a jury of your peers, without that jury being intimidated, pressured and threatened..these are things of the past.
So treat the Just Us System accordingly.

For you have no chance of justice before the mob.
We are back to Burn the Witch and double secret probation..
You will be accused, deemed guilty and you will never know who your accusers are,nor ever learn what crime you committed..
Those who infest our institutions ,proudly turn their ,the institutions, powers against us..As they demand we “Respect the institution”(Law).

Stupid bandits, understanding “No”and “Rules for all or obeyed by none”..is way above their paygrade.

  9. The long and short of what is happening in America at this time is that the Negros have been given big time federal victim status similar native Indians except the native Indians are much smarter and don’t do much violence.

So we have a simian revolt. A bunch of monkeys who do not understand how much better off they are in American than if their ancestors had not been dragged over to Dixie and they were currently still living in the jungles of the old country.

All of our Ancestors had it rough some more than others, but this is now and they need to shut the fuck up and be grateful.

    Enough already.

  10. You know, I was inclined to believe this cop was right in holding Floyd any way he wanted if he felt treatened. I saw the whole video today and I now think this cop is a prick. There was no reason I could see for keeping this guy on the ground in the prone position for that long. He wasn’t going anywhere and they could have sit him up or rolled him to his side to assist with his distress at not being able to get his breath. This cop is a trained prick and should have never been on the police force.
He will be found guilty in my opinion.
