   2. Disobeying a lawful command from his Commander in Chief.
   3. Conduct to the prejudice of good order and discipline.
   4. Acted in negligent and disgraceful matter.
   5. Of course, though harder to prove: conspiracy, obstruction and sedition.

   He is a disgrace to his uniform, his oath and the military ethos, along with staining the officer corps. Personna non grata.

   2. If you have a vehement disagreement with your Commander-in-Chief’s policy direction you can take a number of choices: (Notably in this position you serve “at the pleasure of the Commander-in-Chief”; so if you displease them it will likely be a ‘career defining moment’).

      1. Accept you are not Commander-in-Chief and carry out the order and keep the ‘bitch fest’ to yourself.
      2. Explain to the Commander in Chief the reasons for your deep reservations for the policy choice expressed; then listen for a considered response. Evaluate the response and determine whether you can live with it or not.
      3. Resign your command position, fill out your retirement papers and move on.

   4. Not that simple. (1) Chain of command is a principle and a tradition, but violating it is not a crime. (2) His CinC did not give him a direct order, so he can’t have disobeyed it. (3) Conduct to the prejudice of good order and conduct has to have an action specified which has to be prejudicial. (4) This is same as #3 under the UCMJ. (5) Extremely hard to prove, and based on what we know at the moment, impossible to prove.

      I wonder who writes his fitness report (to borrow Marine terminology) and what sort of markings he will receive?
