    1 Both parents must be American Citizens at Birth.
    2. The Blood line (American & British) is the Father & he must be an American

  14. The real issue with Obama’s country of origin is NOT that he’s “not an American”, but rather that he LIED on his application for college, and thus got a “foreign student” scholarship. He was, in other words, a “diversity admission”. Didn’t have the brains, grades or money to make it otherwise.

    The US Constitutional requirement to be eligible for the Presidency is as follows:
    “No Person except a natural born Citizen, or a Citizen of the United States at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any person be eligible to that Office who shall not have attained to the Age of thirty five Years, and been fourteen Years a Resident within the United States.”

    What could be more telling about the current state of US political and civic life?
    An unreconstructed old-style socialist crank is giving the Democrat heavyweight candidate a run for her money – and actually threatening her campaign.
    A wealthy populist and complete outsider to the Beltway has drawn away a third of the Republican vote and left a long list of “seasoned” candidates in the dust.
    Interesting times!

    The political-driven, factually inaccurate and intellectual vacant Note1 by Paul Clement and Neal Katyal demands a retort. Given my extensive litigation experience in this area, I am compelled by my civic duty to give that reply. In sum, Messrs. Clement and Katyal conclude that: “All the sources routinely used to interpret the Constitution confirm that the phrase “natural born Citizen” has a specific meaning: namely, someone who was a U.S. citizen at birth with no need to go through a naturalization proceeding at some later time. . . . the original meaning of the phrase “natural born Citizen” includes persons born abroad who are citizens from birth based on the citizenship of a parent.” Id. at 161. As I will demonstrate below, such a conclusion fails to be true to the facts and ignores the substantial legal precedent to the contrary presumably as both are inconsistent with the political objective Messrs. Clement and Katyal sought to achieve in their purported ex cathedra, Harvard Law Review Note.

  32. I had the same thought. Then I paused and reflected on Hilary’s reaction on being told that she “won” 6 delegate contests by a coin toss and was only ahead by three or so. “Eek” makes perfect sense in an onamatopoeic sense as being descriptive of what she said…

  35. Well now, normally it would wrong to use “eked” even if you spelled it right. But, Hillary’s rather shrill, isn’t she? I’d say if there’s any proper occasion for saying “she eeked out a tie”, this would be it. I’m going with Kate on this one.
    The arguments against Cruz depend on a rather peculiar view of the Constitution – and bear in mind, “peculiar” isn’t a synonym for “wrong”. The argument is that, while to modern ears “natural born citizen” means “born a citizen” – ie. as determined under the laws passed by Congress for the purpose – to the Founders it meant “natural born” under English common law, to the implicit exclusion of any law passed by Congress for the purpose. They then argue that Cruz would not be regarded as natural born under common law, and thus cannot be regarded as such at all.
    This particular issue doesn’t seem to have been authoritatively decided. I could probably tell you authoritatively whether they have the common law issue right, but it would take a me a day’s work which I have no intention of putting in. US constitutional law is a highly technical field and I’d need a month’s work to put myself in a position to tell you whether the rest of it is wrong. So I’m not saying it’s wrong. But it’s definitely damned odd.
