In 2013 a Romanian cracker named ‘Guccifer’ cracked Sidney Blumenthal’s AOL email account[1]. He released four memos Blumenthal had written for Secretary of State Clinton regarding Libya. Guccifer sent the memos to a large audience including government officials and journalists. Guccifer made a pattern of this type of crack and it lead to his arrest. Guccifer, now known to be Marcel Lazăr Lehel, is serving a seven year sentence in Romania. What interests us all now, is that Guccifer sent his mails to Clinton at a non-governmental address, hrc22@clintonemail.com. Prior to this it had not been publicly known that Clinton used a private email address.
In parallel, the State Department had been going over the Benghazi Commission’s subpoena for Clinton’s emails. They didn’t find any that went to or came from a government address. In August of 2014 [2] they began negotiating with Clinton’s lawyers to obtain the emails from her private accounts. Clinton complied by sending a sifted set of documents to State. She claimed that she had deleted everything else, deeming it personal.
This caused all sorts of consternation with the Benghazi Committee[3]. They rightfully assumed that since Clinton’s emails were not on government servers, that they wouldn’t be getting the full story of what happened then and in the weeks afterward. The State department started to release Clinton’s emails in accordance with a court order laid down in May.
That’s the preamble. At this point Clinton is guilty of horrible judgement and plotting to circumvent the Federal Records Act. She’s a ‘political’ and because she complied with the State Department’s demand for the emails it would appear she’s been absolved of these normally career-ending moves.
When we get into August of 2015 we begin to learn that three agencies, the DIA, NSA and the NGA are pissed at the State Department.[4]. It would seem that in the May, 2015 email dump, State released an email from Huma Abedin to Clinton that contained information that all three agencies considered classified. In addition, between 7Aug15 and the report on 11Aug15 the Inspector General of the Intelligence Community, at the request of Congress, examined two emails and determined them to be the among the highest levels of known US Government classification, TOP SECRET//SI/TK//NOFORN. (Top secret // Sensitive Information / TALENT KEYHOLE [satellite] // Don’t Distribute to Foreign Nationals). This prompted the FBI to seize the computer that was acting as Clinton’s server.[5] This is a serious infraction under US law. Just knowingly having that information outside of government networks is against the law. At this point, Clinton as well as Huma Abedin have serious legal problems.[6]
In January 2016, an article[7] by John R. Schindler caused many a head to start looking at Clinton’s email problem in a larger light. Given his experience in such documents Schindler posited that the intelligence that Blumenthal forwarded to Clinton was actually NSA generated material. In a note of discord against their previous boss, the State Department announced that 22 emails that should have been in the court ordered email dump were not going to be released because they were “top secret”. The article fails to mention if the emails were of the TOP SECRET classification.[8]
Update: On February 1 it was revealed that the Withheld Clinton emails contain ‘operational’ intel, put lives at risk. John R. Schindler continues to be the ‘go to’ resource to fill-in some of the blanks in the Fox report. [15] These are now very serious allegations and I hope the USG and her allies are/were able to extricate their members of the intelligence community.
That’s a quick summary of what is in the public domain regarding Clinton’s email problems. Clinton is banking heavily on ‘political impunity’ and the the word ‘knowingly’ in 18 U.S. Code § 1924. In light of a released email in which Clinton instructs Jake Sullivan to turn the information into ‘nonpaper with no identifying heading and send nonsecure’, I’d say her defense is thin.[9]
We can rule out ‘accidental’ as well because outside of the Internet, there are three other physically separated networks (not including segments where tunnelling is in use) all at play; NIPRNet (which does provide gateway access to the Internet), SIPRNet and JWICS. NIPRNet (Non-classified IP Router Network) is where the aides would have emailed from. SIPRNet (Secret IP Router Network) is a parallel but separated physical network for SECRET level classifications. JWICS (Joint Worldwide Intelligence Comunications System) is yet another physically separated network for the TOP SECRET classification. In order for the TOP SECRET information in Clinton’s server to have gotten there it would have had to be physically copied from JWICS to NIPRNet and then emailed out. This is a well-written if simplified article that describes these networks and what a person would need to do to move information from one to the others.

There’s plenty of chatter that the FBI will “go public”with what they know if they cannot have the Justice Dept. bring charges against her.
Will any of this see light of day prior to the election in November? Trey Gowdy is promising to release his Congressional report sooner rather than later, and that it will be hard hitting.

I don’t think that’s much of an issue per se. The Clintons are both a business and a foundation with considerable assets. Like any other well-heeled business they can certainly afford to run their own server and .com address (there is, after all, a http://www.trump.com).

The only logical reason I can think of is that Hillary wanted to share state secrets with others for money.
While I wouldn’t put that past her, I don’t think it’s necessary to go that far. If, as I suspect, she’s a paranoid megalomaniac this would be just something she would do as a matter of course – keep all her communications under her control and away from any source of oversight or independent review. She doesn’t consider the US government’s authority over her as Secretary of State to be legitimate or the oaths she swore to be binding. The fact that the whole thing was so ridiculously sloppy is pretty strong evidence she wasn’t intentionally committing treason, because I have to believe she’d be better at it. Then again, technology does seem to confound even the cleverest of psychopaths, and she’s pushing 70.
As long as Obama is prez and controls the justice department, there will be no charges brought against her. If she becomes prez, control will pass to her and there will be no charges.
All those who are salivating over the prospect of her imminent indictment, forget it. Not going to happen.

Oh, this is a scandal, but instead of pursuing a great story, the bulk of the MSM wants this to disappear, since it doesn’t fit their agenda.
For me, the most intriguing part is the role of Sid “Vicious” Blumenthal. If he hasn’t been interviewed by the FBI, I’d be surprised. I wouldn’t be surprised, however, if Sid were looking for a new pied à terre in some country without an extradition agreement with the US.
As for the poor schmuck(s) who passed the info to Sid, I’m guessing they are having serious panic attacks about now, and are consulting some very good attorneys.

HRC: “I had no knowledge of that break-in, I mean emails.” From present evidence I think she will skate, legally anyway, on this peccadillo. She probably has enough legal ambiguity and political cover; however, that could change as new details are revealed &/or new witnesses emerge. If this is all there is, in spite of her obvious transgressions, she is almost certainly good to go to continue her run at POTUS.
HRC will now claim that while highly classified material was on her server, she was unaware of it, and certainly didn’t read or review any of the top secret emails, ipso facto she didn’t “knowingly” place or allow that information to be there. It was just an accident by a State official, that’s whom the FBI are investigating. That’s simply not believable and we’re just expected to forget her other defenses, which make this latest seem at best inconsistent, in which she previously implied she had access to classified emails from/on her private server/blackberry.
That also assumes her underling, who took the fifth, or others didn’t indeed remove security levels, or if he/they did, they don’t crack under pressure. Her argument would have to further require she had no knowledge of any classified emails on her private server, because as a federal employee she has a responsibility to safeguard that information once in possession of it, and would have known this was an offence. Then again she seems to insist on the “I didn’t see any security markings” argument, which on its face seems folly. BTW, Hillary is not out of the woods on cooperation with State because she redacted/deleted thousands of emails she had been ordered to turn over.
Now the FBI has her hard drive and apparently has recovered erased emails, so we will see. There can be little doubt the intelligence community is really po’d with her, along with probably the diplomatic corps.
IOW she didn’t know how to do her job, that’s the best she can hope for. Indeed, Hillary has lots to worry about. The FBI is also investigating her mixing of government and personal business with the Clinton Foundation. That stink could turn out to be the real bombshell. Sidney Blumenthal had to resurface sooner or later and given he is persona non grata in the WH and Obama administration, he is the random variable in all of this and is a strong link to her judgment in Libya, given this fellow has zero intelligence or otherwise useful experience on this issue. His conduct may colour the Obama administration’s attitude.
He is a political operative whose involvement could open up that whole can of worms over the “video” which, hopefully, the GOP will be ready for her response (the usual, when Dems are investigated. Your bad – seeking the truth. My bad – political witch hunt), then expose her callousness around the lost lives and her mendacity with the families.

Unfortunately, no it isn’t.
The line “If they can’t, turn into nonpaper w no identifying heading and send nonsecure” is just ambiguous enough: it does not prove that the original document itself was classified, giving wriggle room to the Clintons (always a dangerous thing to do).
Any prosecutor would have to clearly link that email to a specific classified document; the words “no identifying heading” could mean anything or nothing in the hands of a skilled defence lawyer (and the Clintons can afford one).
However, this email is still useful (and therefore quite damning) in another way. The Clinton defence seems to boil down to something like “it’s not my fault if someone else sends me an email with classified material in it” (in and of itself, that is quite true, if utterly disingenuous). But the “send nonsecure” email above suggests Hillary knew full well State Department flunkies were air-gapping material off closed systems and sending it to her over the Internet. Indeed, it implies they were doing it at her behest.
Was the material on Hillary’s server “classified”? I suspect her defence will end up paraphrasing her husband’s words from another dodgy episode: “It depends upon what the meaning of the word ‘classified’ is”.
She might well get away with it!
