At a hearing Monday in Manhattan in which he ruled filmmaker Dinesh D’Souza must continue community service for four more years, U.S. District Judge Richard M. Berman said he considers D’Souza’s violation of federal campaign-finance laws to be evidence of a psychological problem and ordered further counseling.
D’Souza’s defense counsel Benjamin Brafman provided evidence to the court that the psychiatrist D’Souza was ordered to see found no indication of depression or reason for medication. In addition, the psychologist D’Souza subsequently consulted provided a written statement concluding there was no need to continue the consultation, because D’Souza was psychologically normal and well adjusted.
But Judge Berman, who was appointed by Bill Clinton, disagreed, effectively overruling the judgment of the two licensed psychological counselors the U.S. probation department had approved as part of D’Souza’s criminal sentence.

  3. Quite so, Mr Murphy. There are remarkable similarities in the way the law is being used against conservatives and the way it was employed against “uppity” minorities in the Jim Crow South.

    In the Soviet Union, a systematic political abuse of psychiatry took place[1] and was based on the interpretation of political dissent as a psychiatric problem.[2] It was called “psychopathological mechanisms” of dissent.[3]
    During the leadership of General Secretary Leonid Brezhnev, psychiatry was used as a tool to eliminate political opponents (“dissidents”) who openly expressed beliefs that contradicted official dogma.[4] The term “philosophical intoxication” was widely used to diagnose mental disorders in cases where people disagreed with leaders and made them the target of criticism that used the writings by Karl Marx, Friedrich Engels, and Vladimir Lenin.[5]

  7. I reread both 1984 and Brave New World this summer. It is getting very scary to see how close we are getting to the levels of social and political control as depicted in these books. We are likely to see a version of Fahrenheit 451 (another favorite book of mine) going into effect during my lifetime. God help us all (save a space in the re-education camp for me, I just used the worrd God).

    I’d say we’re about 4/5 of the way to Fahrenheit 451 already.

  9. I’ve seen film footage of the Nazi judges who stopped following the law and simply followed the wishes of their totalitarian masters. This follows the same pattern. “Kangaroo Court” doesn’t begin to describe what’s going on here.

    Dinesh D’Souza has cessed to be a mere Political Dissident, he is now a Political Prisoner, imprisoned by the Liberal Democrat system for voicing his beliefs while wearing the wrong color of skin.

  12. Most of those of younger age don’t know this and may not believe it.
    Most of those in their sixties and up probably don’t know or may not believe it.
    This was the standard procedure by communists, to set aside if not kill, those that they found to be much in the same way as D’Souza find himself in, more than 25 years after the fall of communism.
    There are millions of illegal aliens in the US of whom many (I know this is a wide concept though it seems appropriate in this case), will vote because judges will close their eyes.

    The Democrats will do their best to see to it that the illegal aliens will get to vote. Somehow that is OK.

    Is it not interesting that the socialists that the Democrats are, are following in the footsteps of communists.
    Don’t know if the national socialist did the same, though it would not be a surprise.
    It does seem that the USA is becoming a lawless society.
    This will lead to a totalitarian state where many will be put to prison and many will die for no other reason than having a different view from the ruling class.

    Look back at the communists, they ruled with iron fist. Killing in judicial style, though trials that were scripted, actually, in fact, scripted, for the accused as much as for the prosecutors. Your agent read the script many years later. The communists killed about 80% of the ministers of the postwar government. The documentation is still available, though don’t know if in English.
    Those that lived under communism had very little and no chance to live in a free society.
    It fell like house of cards.
    Ha, looki here the once beacon of freedom is going to try it out.

  14. Well Lev, I believe it as I lost many of my relatives that way. Some shot, some died and some broken in re-education labour camps.
    All of the above with special mention to Hans.
    robw, I have not read Brave New world and Fahrenheit 451 and will rectify that.
    Our HRC kangaroo courts were just the beginning.

  15. Ken; I am able to speak from experience of the “Cottage Industry” that has grown around the Tribunals of the Human Rights Commission.
    This starts with the Crony bag men of the Government at the higher levels of being Entitled to their Entitlements.
    My experience goes back several years , where we experienced an inept “Adjudicator” alegedly earning $165,000.00 per year with expenses and basically acting as agent for the accuser in a case by of discrimination by an employee against our small business and proven false through extensive documentation. It nevertheless forced our small company to agree to a settlement as we could no longer afford the legal expense.
    Naturally the discrimination claiment did not face any legal expense and would not be admonished in any manner if we persisited in placing the company in jeopardy through the ever increasing expense. If we had been forced to close by this travesty Firteen long term Employees would have lost their jobs.
    The advice from our Legal advisor, part of the “Cottage Industry” only served to move the farcial process along the path of the Kangaroo.
