Ian Hunter on the problem that, unbelievably, persists:

"The evicted property owners of Kahnawake are without a remedy because Canadian law is not applied on Indian reserves. Ms. Nolet is without a remedy because human rights law is applied to private parking places — but in a manner that any reasonable person would consider to be totally arbitrary."

The condo decision is really quite unbelievable. This is a situation where two people purchased a condo AND a parking space...the locations of which were known. The Human "Rights" Commission has interfered in a commercial transaction...that is far, FAR beyond their jurisdiction. HRC's should be disbanded entirely. They are disgraceful.

That condo decision was likely based upon the old principle:
"It's NOT WHAT you know but rather WHO you know."

Kafka would find Canada an odd place for equality and fairness in jurisprudence.

I'm curious, and the article by Ian Hunter does not specify, whether the parking spot was rented or owned by Ms. Nolet. That is, was she simply paying for example $100 per month to use the spot. Or, did she pay for legal ownership of the parking spot in addition to her condo unit. Let me be clear, the HRC decision is egregious in either case.

But, many condo developments will stratify the parking spots themselves for sale (complete with full legal address and PID number). If this is the case, the HRC is not only interfering in a commercial transaction (as correctly pointed out by John above), but also interfering in private property ownership.

As outrageous as the HRC fiat is, it pales alongside the gravity of the evictions at the Mohawk reserve.

We have a huge elephant in the middle of the room that nobody wants to tackle: ours is not a nation with one set of laws for everyone. We have two sets of laws; one for the "First" Nations, the other for everyone else.

That is a MASSIVE problem.

I commented on this "hierarchy" sometime back, I believe I listed them 1-10. Using deductive reasoning similar to the writer I concluded that Race trumps Gender based on my observations during the Democratic primaries.

It has long been clear in human rights jurisprudence that there is a hierarchy of prohibited grounds of discrimination; race and sex always trump, say, religion or age. We shall now await the formulation of a hierarchy of disability; obesity, we now know, trumps a sore shoulder.

As much as I hate and despise the HRC's,how can they interfere in private property when we DO NOT have any such right in Caunckistan?? NO WHERE in any document is private property stated as a RIGHT in this soviet republic. Thanks Turdeau.

Perhaps the parking spot's comments had the capacity to cause hurt or harm?

So two adults couldn't resolve their differences? Why involve a kangaroo court? How many people do not feel deprived if they lack a parking spot? If human rights commissions think average citizens are going to let them push them around forever, imagine the looks on their faces when they realise John Q. Public can and will fight back.
Dare I be controversial? Yes. Throw out the Indian Act. Integrate everyone. Let everyone be equal under the law. I'd like to see Mohawk elders pull that racist crap knowing they could get sued for it.

Ian Hunter is a formidable champion of commonsense and decency, we can count our lucky stars for his likes. Chuck Strahl is very disappointing here, I would have thought he, at least would stand up and tell the natives to go to Hell. I wouldn't have thought it possible, but the native has become an embarrassment to him/herself. Where is the noble and brave sentiment we hear so much about?

not only is there no "property ownership" in kanada, there is no individual "improvements" ownership in a condo situation, because the corporation "owns" it and you are a stake holder in the corporation


but, yah, the HCR has NO legal say in the matter, and it should be hauled before a real court

If what is suggested in the latest news about this Jaffer guy, I'm beginning to think that some people jumped on the conservative bandwagon for their own benefit. I have absolutely no respect for those fooling with drugs. You use it, you support its use. I've seen too many peoples lives ruined by it, he should be banned from any affiliation with the party.
