Actually, Tony - it was deeper than that. I caught his drift and I'm quite confident that Kate caught it too.

As a follow up to the Bill Whatcott post from a few weeks ago, I note the Law Society of Saskatchewan now has the written decision on its site. An item of great interest to me caught my attention as I read the decision. That item is that the Appeals Court identified that the HRC was prosecuting the "essential message" as opposed to the manner in which the "essential message" was communicated. (It would be interesting to see if a similar ruling would eventually be granted in the Netherlands in the Wilder proceedings.)

I have had an interest in this case and in the Stephen Boission case in Alberta because I and many people I know hold similar views on the issue of homosexuality. I think we would express our thoughts differently than the two men in question but there are similarities in content. I generally consider myself to be gentle in nature and am almost always soft spoken in conversation. On this day, which incidently is the day of the death of Fess Parker, I remember that I see similarities between the actor, Fess Parker and myself in how I deal with my family and with others. Although I cannot be sure, I get the distinct impression that both men in question would be less gentle and polite in conversation than either Parker or myself.

Although there is a certain intensity of conversation that comes across from the written material in both cases being considered, any impoliteness or even rudeness does not rise to the level of, say, the insults directed to officials in a Canadian amateur hockey game or to the level of insults occurring daily in a Canadian political blog. Having not even risen to these levels, the comments obviously did not exceed those levels.

For a court or Tribunal to have found these men guilty would mean that it would need to find them guilty on another matter. Most of us know what that other matter is. It would be on the thought itself; it would be, in essence, a heresy trial. Whereas most know this to be true, it is quite another matter for an Appeals Court Justice to say such a thing. Alberta Justice Wilson did not quite say such a thing in the Boissoin appeal, but the Justice in the Whatcott decision did find that the expression of the thought ("essential message") was the offending deed itself (bolding is mine in the quotes below).

[68] The Tribunal selected six phrases out of two paragraphs of text.The Tribunal stated that it must find that it exposes or tends to expose to hatred as defined in Bell. The Tribunal failed to describe why these words or phrases, alone or in combination, met the definition of hatred of detestation, calumny and vilification. This list of the above words and phrases were taken out of the context of the sentences or paragraphs in which they were stated in the flyer and then, without any analysis, the Tribunal said it had “… no hesitation in concluding that the material contained therein can objectively be viewed as exposing homosexuals to hatred and ridicule.” To apply an objective test requires more than a conclusion that purports to have been arrived at objectively.

[136] While exception is understandably taken to the extreme language used in and on these flyers, the position of the complainants and the Commission would not differ, in my view, if more polite language were used to express the same views, for the real objection is to the essential message of the flyers and this would remain. The flyers are critical of same-sex conduct. The authors do not want tolerance of that conduct to be taught in schools and they do not want young people to be exposed to it. Thus, the concerns of the complainants and the commission with these flyers are not advanced, in my view, by a close analysis of the emotive level of the negative language used in them and this analysis is largely beside the point.

A) Canadian Problem at Provincial parks in Saskatchewan on the Spring May long weekend.. Dunks at the Campgrounds creating a public disturbance. The many Families camping complained that the behavior was not conducive to Canadian values they wanted to teach their children.

The Saskatchewan NDP government took aim at demon alcohol, although most campers consume alcohol responsibly, they prohibited possession of all Alcohol in the provincial Parks on the May Long Weekend. This pushes the problem to private Cottages

B) The Philadelphia Eagles problem at Veterans Stadium of Drunks fighting & Creating a public disturbance. The many families attending the football games complained that the behavior was not conducive to American values they wanted to teach their children

The solution was not to bane the sale of Beer,,, but Drunks..
