The Supreme Court of Canada has refused to order the Harper government to seek Omar Khadr's repatriation from Guantanamo Bay, Cuba.

In a unanimous ruling Friday, the court said that Mr. Khadr's constitutional rights were violated, but concluded that it would intrude on the government power over foreign relations to force officials to ask the U.S. to send the accused terrorist home.

"The appropriate remedy in this case is to declare that Khadr's charter rights were violated, leaving it to the government to decide how to best decide in light of current information, its responsibility over foreign affairs and the charter," said the 9-0 ruling.

The decision overturns two earlier rulings that ordered the government to request Khadr's return to his birth country, as payback for its maltreatment of the 23-year-old.

Mr. Khadr has been detained at the U.S. military compound at Guantanamo since 2002, where he was sent after allegedly throwing a grenade that killed a U.S. soldier following a shootout between American forces and al-Qaeda fighters in Afghanistan.

He faces five charges, including murder as a war crime, and is scheduled to be tried in July before a military tribunal.

Prediction: approximately 20,000 anti-proroguing protesters will soon be 20,000 pro-Omar protesters following a Facebook campaign by the usual suspects.

Love the outcome and am happy that the Supreme Court seemed to place national interests as determined by the government ahead of individual human rights.

But the court left final say on repatriation up to the government, concluding it is in the best position to assess the impact on foreign relations, while taking into account Canada's broader national interests.

And this without the resort to the "Notwithstanding" clause!

Drat. I was hoping that Harper would get the chance to pummel that bunch of Supreme activists with a big notwithstanding stick.

Interesting, the court said his Charter Rights were violated when the Liberals were in power. I wonder how much emphasis that will get in the news tonight.

Al the fish, here in Kelowna the grassroots anti-proroguing rally gathered 100 people on last Saturday afternoon, a reasonably warm day about plus 5. Population of Kelowna is about 90,000 on this side of the lake.

The Olympic torch ceremony was held Tuesday night at the City park downtown, 15,000 of the "grassroots" showed up for that ceremony, in the dark and cold.

What is the most surprising to me is that the lower courts felt it to be within their power to order the Canadian government to act in a certain way on the international stage. This case should never have gotten anywhere near the Supreme Court.

I agree with one of the commenters in the NP. This guy was an un-uniformed enemy combatant. The Yanks could simply have shot him on the battlefield.

Because a Canadian interrogated him at Guantanamo, his Canadian Charter Rights have somehow been violated. Uh, huh.

How were Little Omar's consitutional rights violated and by whom? I presume the court referred to Canadian constitutional rights but he is not and has never been in Canadian custody. So no Canadian rights (real or imagined) have come into play. And our court doesn't have jurisdiction over the US or its military so it cannot be US rights they were referring to.

Aside from this sop to the leftards about rights, it was a good decision. The courts have no business telling an elected government how to conduct foreign affairs.

The sooner that Khadr is tried and executed, the better the world will be. Don't let this infected POS loose!! Ignatieff's comments were to the effect that Khadr should be brought back to Canada immediately by the government. Past polls have shown that Canadians don't care about Khadr - we don't want him back. So why does Ignatieff drone on about an issue that Canadians don't care about. And this certainly isn't the first time he has done that.

I love the MSM's attempt at trickery, often times citing the current gov't for its scorn and derision by labelling it the "Conservative gov't". But whenever Khadr is referenced as a child soldier in their reports, they'll generically use the "Canadian gov't at the time" as their description, unwilling to remind Canadians that when they see the interrogation videos so often shown by MSM to garner sympathy for the little terroist, the Liberals were in power at the time. For the uniformed and undecided voter, which in many ridings can determine who wins and who loses, it leaves an impression that the Conservatives and PMSH were in power when those videos were made. Khadr was 19 when the Conservatives came to power. "Child soldier" and "Conservative gov't" should not be put in the same sentence. It's patently misleading.

I just took a quick gander at the SCOC decision, and it is obvious the decision is a poor reflection on the Liberals who were then in power.

For all the hue and cry about Afghan detainees rights, the Liberals themselves contravened their own Charter through staff at CSIS and DFAIT in the matter of Omar Khadr.

Guantanamo is clearly an 'extra-judicial detention site' from the Court's point of view.

Given that the Charter doesn't apply outside of Canada the SCOC doesn't have jurisdiction to compel the US to abide by it's rules. Sovereign state and all that...and defaults foreign policy decisions to the Canadian government.

Long and short of it is that Canadian goverment employees are bound by the Charter...no big surprise there.

I do disagree with the National Post describing the Omar Khadr as a 'child soldier' as he never donned a uniform while in action. Perhaps a more accurate description would be 'child combatant without a uniform'.

Hans I don't know what to think. I agree with your analysis, yet we seem to be considering terrorists as enemy combatants. Fine, I can handle that; perhaps the Geneva Convention is out dated, right? (Perhaps the Geneva Convention is discriminatory and insensitive to soldiers in armies/terror organizations that cannot afford or provide uniforms for the workers./sarc) But it seems(as per usual) that Omar advocates (the left) want their cake and to eat it too. If Omar is an enemy combatant and entitle to Geneva Convention rights, then wouldn't Omar be a POW? If Omar is a POW, is he entitled to Miranda rights, or a "fair" trial? I thought POWs are held until the war is finished, not extradited . All of this, Omar related or not, seems to stink of lawyers and politics to me, not winning a war.

What peace advocates fail to realize, or realize but don't care because of their real agendas: is that in future conflicts real victims, child soldiers, and POWs will be less likely to walk away from the battle field because of their political shenanigans. Well done leftards!

In all seriousness, the "supreme court" could not justify assuming control over foreign policy, much as they would like to.

If he were brought to Canada, he would have to be immediately released as he has committed no crime by Canadian law, on Canadian territory. So, then, he could run home and live with the rest of his vile, Canadian-hating, familly who are only here because of the evil free health care.
